LD998 An Act Regarding an Employer's Authority to Prohibit an Employee from Storing a Firearm in the Employee's Vehicle This bill modifies the provision of law governing an employer's authority to prohibit an employee from storing a firearm in the employee's vehicle. The current law states that an employer is not permitted to prohibit an employee from storing a firearm in the employee's vehicle if the employee has a valid permit to carry a concealed firearm under the Maine Revised Statutes, Title 25, chapter 252, as long as the vehicle is locked and the firearm is stored out of sight. The bill removes the specification that the employee must have a valid permit to carry a concealed firearm. In Committee
LD1325 An Act to Create Clarity in the Laws Regarding Property Tax Abatement Appeals This bill provides that an applicant for a property tax abatement may not apply to the county commissioners to appeal a decision of the assessors or the municipal officers with respect to nonresidential property or properties having an equalized municipal valuation of $1,000,000 or greater, either separately or in the aggregate. An applicant must make such an appeal to the State Board of Property Tax Review. Passed
LD1746 An Act to Reduce Dental Disease and Ensure Access to Essential Preventive Dental Care Among Maine Children This bill does the following. 1. It delays the requirement for oral health services to be available in all schools from January 1, 2025 to January 1, 2027 and clarifies that the requirement applies only to public schools. 2. It requires the Department of Health and Human Services to develop public-private partnerships to establish a model to provide for mobile dental services providers to provide additional preventive oral health and disease intervention services in schools based on the model in the Cumberland County School Oral Health Project. It requires the department to provide for at least one mobile dental services provider in each public health district per school year. 3. It requires the Department of Health and Human Services to provide training and education to primary care providers on minimally invasive dental disease treatment for infants and small children using guidance from the From the First Tooth program or its successor program and the American Academy of Pediatrics. Pediatricians are encouraged to use silver diamine fluoride in primary care settings to reduce dental disease and prevent cavities. 4. It makes permanent 2 previously established limited positions related to provided oral health services in public schools within the Department of Health and Human Services, Maine Center for Disease Control and Prevention. LD1955 An Act to Increase Child Care Affordability and Early Childhood Educator Stability This bill does the following. 1. It replaces the early childhood educator workforce salary supplement system with the Salary Sustainability Program for Child Care Professionals. It establishes requirements for the program, requires 5-year assessments and provides funding for the program. 2. It enacts the child care staff scholarship program established as a pilot program in Public Law 2023, chapter 643, Part TT as a permanent program in the Maine Revised Statutes known as the Maine Child Care Affordability Program Child Care Award. 3. It establishes a program of child care provider scholarships for early childhood education or related fields to eligible individuals pursuing associate, bachelor's or graduate degrees or certificates in those fields. 4. It establishes a program of apprenticeships for individuals employed or seeking employment at a licensed child care facility or licensed family child care provider. 5. It requires the State Board of Education to update its plan for career and technical education centers to include opportunities for early childhood education and child care education at career and technical education centers around the State. 6. It requires the Department of Health and Human Services to develop a long-term plan for financial sustainability of the Maine Child Care Affordability Program and submit a report to the Joint Standing Committee on Health and Human Services no later than January 2, 2026. 7. It requires an appropriation of $3,800,000 to the Maine Child Care Affordability Program and a yearly appropriation of $500,000 for wage supplement awards and $1,000,000 to support child care needs. The bill also requires the department to monitor out-of-state electronic benefits transfer, or EBT, system transactions and terminate the benefits of any recipient who makes solely out-of-state EBT card transactions over a 90-day period and is determined to no longer reside in the State or does not respond to department contact. LD1812 An Act to Establish the Loans for Trade Tools Program This bill, to encourage participation in the trades, does the following. 1. It establishes the Loans for Trade Tools Program, which is a program administered by the Finance Authority of Maine to provide low-interest loans to graduates of a trade program for the purchase of tools and equipment necessary for employment in a trade. Loans are limited to $20,000 and must be repaid within 10 years. If an employee maintains full-time employment, meaning at least 32 hours per week, in the trade, that employee's loan may be forgiven. 2. It establishes a tax credit for employers of employees engaged in a trade for the purchase of tools or equipment needed by that employee within the first year of employment with that employer. The credit is limited to 25% of the amount of the cost of the trade tools and $5,000 per employee, is nonrefundable and may not be carried forward from year to year. 3. It provides an appropriation of $1,000,000 for each year of the 2026-2027 biennium to the Finance Authority of Maine for the Loans for Trade Tools Program. Passed
LD660 An Act to Provide Transparency and Public Access to Public School Curricula This bill requires school administrative units to adopt policies and procedures to ensure that the approved curriculum presented is implemented in the classroom without change, to post at least 3 years of data regarding certain student enrollment and performance, to maintain lists regarding participation in and development of professional development programs and to create an online portal that will act as the single source for all student information and data that can be accessed by 3rd-party contractors, including curriculum materials and information regarding speakers and guests. The bill requires the Department of Education to list and make available to the public all administrator, teacher and staff professional development and instructional programs offered to schools that are paid for with state funds and maintain a list of school boards that have approved a statewide program. The bill places restrictions on the choice of academic class offerings and curriculum materials and on-site professional development programs. Certain provisions of this bill are designed to satisfy federal law related to parental access to information and protection of pupil's rights. Dead

LD1903 An Act to Conform the State's Perfluoroalkyl and Polyfluoroalkyl Substances Laws to Federal Standards This bill conforms state standards for certain perfluoroalkyl and polyfluoroalkyl substances, or PFAS, to federal standards in the following ways. 1. It establishes soil concentration levels for PFAS for the purposes of determining when land is contaminated by PFAS under the Fund To Address PFAS Contamination. 2. It amends the law authorizing the adoption of state drinking water rules by the Commissioner of Health and Human Services to require that those rules establish a maximum contaminant level equivalent to the standards of the United States Environmental Protection Agency's national primary drinking water regulations adopted in April 2024 for certain perfluoroalkyl and polyfluoroalkyl substances. 3. It provides that federal law or regulation regulating the sale of a food package to which PFAS have been intentionally added preempts state authority to prohibit the sale of such food packaging. 4. It provides that if surface water quality standards for PFAS are established pursuant to federal law, the Department of Environmental Protection must adopt rules for surface water quality standards to match the federal water quality standards. 5. It provides that if the United States Environmental Protection Agency adopts emissions standards for PFAS, emissions standards for PFAS adopted by the Department of Environmental Protection, Board of Environmental Protection must be the same as the emissions standards established by the United States Environmental Protection Agency. The bill requires the Department of Health and Human Services to amend its rule Chapter 101: MaineCare Benefits Manual, Section 25, Dental Services and Reimbursement, to reimburse all dental services at 75% of the national state Medicaid rates and to provide reimbursement for all dental case management codes. LD637 Resolve, Directing the Department of Health and Human Services to Evaluate the Municipal General Assistance Program Database This resolve directs the Department of Health and Human Services to issue a report to the Joint Standing Committee on Health and Human Services on an evaluation of the feasibility of upgrading the database for the municipal general assistance program to allow the determination of whether a disqualified applicant is seeking assistance in another municipality. If the department determines that the current database cannot be upgraded, the department is to research a suitable replacement database that fulfills the criterion. LD1951 An Act to Promote Food Processing and Manufacturing Facility Expansion and Create Jobs This bill amends the laws governing the income tax credit for major food processing and manufacturing facility expansion in the following ways. 1. It removes the requirement that an applicant's headquarters are, and have been for each of the last 5 years prior to application for a certificate of approval, located in the State. 2. It requires that an applicant employ or will employ within 12 months of the start-up of the facility at least 40 full-time employees based in the State. Current law requires that an applicant employ or will employ upon start-up of the facility at least 40 full-time employees based in the State. 3. It changes the criteria to be considered a qualified and certified applicant. 4. It increases the total value of certificates of approval that the Commissioner of Economic and Community Development may issue from $100,000,000 to $200,000,000. It also increases the cap on an individual certificate of approval from $85,000,000 to $100,000,000. 5. For a tax year beginning on or after January 1, 2027, it increases the amount of the credit a certified applicant is allowed from an amount equal to 1.8% of the certified applicant's qualified investment to an amount equal to 2% of the certified applicant's qualified investment. 6. It removes the provision that provides that a credit is not allowed for any tax year following 2 consecutive tax years during which a certified applicant did not have between $5,500,000 and $12,000,000 in ordinary business income. LD1799 Resolve, Directing the Department of Health and Human Services to Review the Progressive Treatment Program and Processes by Which a Person May Be Involuntarily Admitted to a Psychiatric Hospital or Receive Court-ordered Community Treatment This resolve directs the Commissioner of Health and Human Services to convene a stakeholder group of interested parties to review the entire process related to a progressive treatment program under the Maine Revised Statutes, Title 34-B, section 3873-A and to review for efficiency and effectiveness the processes by which a person may be involuntarily admitted to a psychiatric hospital or receive court-ordered community treatment pursuant to Title 34-B, chapter 3, subchapter 4, article 3. The commissioner is required to submit a report with recommendations to the Joint Standing Committee on Health and Human Services no later than December 3, 2025. LD1753 An Act to Establish the Upper St. John Valley Recovery High School Program This bill requires the Department of Education to establish the Upper St. John Valley Recovery High School Pilot Program, a 3-year pilot program based at the campus of the University of Maine at Fort Kent and operated by the Valley Unified Education Service Center, or its successor organization, to educate high school students in recovery from substance use disorder or co-occurring disorders. The bill requires the program to provide supervised housing to enrolled students during the school week and requires students to participate in a concurrent, complementary program of recovery from substance use disorder or co-occurring disorders while enrolled in the program. The program must address requirements for awarding secondary school diplomas to students enrolled in the program. The bill also requires the Department of Education to work with the Department of Health and Human Services and the Valley Unified Education Service Center to establish the curriculum and enrollment criteria for the program. LD1891 An Act to Address the Dental Professional Workforce Shortage by Establishing Scholarship and Loan Programs and Updating the Dental Care Access Tax Credit This bill establishes the Dentists for Maine's Future Scholarship Program to provide a tuition subsidy of 50% of the cost of attendance, up to a maximum of $25,000 per student annually, for eligible students who enter dental school programs in this State for the purpose of increasing the number of dentists in this State who practice in extreme shortage areas of the State. The bill also establishes the Extreme Shortage Area Dental Education Loan Program to provide loans and loan repayment agreements to eligible dental students and individuals who are eligible for licensure as a doctor of dental medicine or as a dental hygienist, dental therapist, expanded function dental assistant or dental assistant who agrees to serve an extreme shortage area in the State. The bill also updates the dental care access tax credit to include eligible dental hygienists and changes the date that the tax credit is repealed to December 31, 2032. Dead

LD1758 An Act to Expedite Provider Enrollment in MaineCare This bill establishes an expedited process for providers to enroll in the MaineCare program. Under the bill, the Department of Health and Human Services must provisionally approve the enrollment application of a provider in good standing that has a national provider identifier within 48 hours of receipt of a complete application if the provider is employed by a health care entity that has an enrollment application approval rate of greater than 90% in the previous 5 years. The department may conduct a complete review during a 60-day expedited provisional approval period, but the provider is considered approved after 60 days if the department does not affirmatively deny approval during that period. However, the bill does not prevent the department from suspending or revoking approval after the 60-day period if a material deficiency exists. If the provider's approval is revoked, the provider is not eligible for expedited reenrollment but must go through the regular enrollment process as established by rule. The Office of MaineCare Services may seek reimbursements for any payment made to a provider during the provisional period if the provider's provisional approval is revoked. The department must adopt rules to implement these provisions. Dead

LD1531 An Act to Better Protect Animal-drawn Vehicles and Motorists on Public Roadways This bill repeals the current law relating to light and reflective gear requirements for animal-drawn vehicles operated on a public way and replaces it with more detailed light and gear requirements for the operation of animal-drawn vehicles at all times and additional requirements for times when there is limited visibility. The bill also provides an exception for animal-drawn agricultural equipment that is not transporting any livestock or a person other than the operator. Dead
LD1108 An Act Regarding the Reunification of Foster Children with Their Parents This bill requires the Department of Health and Human Services, when developing a rehabilitation and reunification plan with respect to a child in foster care, to include random screening for illegal drugs for parents in treatment for substance use disorder. The bill requires the department to schedule meetings so as to allow for the attendance of the parent to the extent possible, to conduct random screening for illegal drugs for parents in treatment for substance use disorder and to conduct unscheduled home visits with the parent. It also requires a parent seeking reunification with the parent's child to make good faith efforts to cooperate with the department, including by attending meetings with the department. It provides that the department may not petition for judicial review and return of custody of the child to the parent earlier than 6 months following removal of the child from the parent's home. Dead

LD1237 An Act to Support Adult Family Care Homes and Residential Care Facilities That Are Small or Located in Rural and Isolated Areas of the State This bill requires the Department of Health and Human Services to amend its rules in Chapter 101: MaineCare Benefits Manual, Chapters II and III, Section 2, Adult Family Care Services, and Chapter III, Section 97, Private Non-Medical Institution Services, Appendix C, to provide a supplemental payment of 10% to the MaineCare rates for facilities that have fewer than 10 beds or are at least 35 miles away from the nearest similar facility. The bill also requires the Department of Health and Human Services to determine the likely impact of proposed rule changes to reimbursement and staffing requirements to long-term care facilities on small, rural, isolated and island facilities to reduce impacts on the communities where those facilities are located as well as the impact on safety and quality of services. It allows an outdoor wood boiler meeting a particulate matter emission limit of 0.32 pounds per million British Thermal Units heat output to be exempt from property setback requirements as long as it meets applicable stack height requirements under Department of Environmental Protection rules. 2. It prohibits the department from adopting rules applicable to outdoor wood boilers that prohibit the emission of a smoke plume from an outdoor wood boiler, regardless of whether such emission remains upon the property of the owner of the outdoor wood boiler or crosses onto any adjacent land or buildings not owned by the owner. LD557 An Act to Allow All-terrain Vehicles to Be Used on a Public Way This bill, beginning January 1, 2026, allows the operation of an all-terrain vehicle, or ATV, on a public way as long as the ATV is registered and meets specified safety equipment requirements, and the operator is licensed and has insurance. The bill requires the payment of the resident or nonresident ATV application fee to register an ATV for use on a public way. The bill does not affect the operation of ATVs off of public ways. The bill prohibits the operation of an ATV on a public way with a posted speed limit of more than 50 miles per hour. The Department of Transportation may adopt rules, or a municipality or county may adopt an ordinance, to restrict or prohibit the operation of an ATV on a public way if the department, county or municipality determines that the prohibition or restriction is necessary in the interest of public safety.
