LD839 An Act to Create the Net Energy Billing Cost Stabilization Fund This bill prohibits the inclusion of certain costs associated with the kilowatt-hour credit and commercial and institutional net energy billing programs in the operating expenses of a transmission and distribution utility. The bill requires the Public Utilities Commission to adopt routine technical rules to establish a process by which kilowatt-hour credit program costs and commercial and institutional program costs, less monetized benefits, are distributed to transmission and distribution utilities and distributed generation resources, as applicable. The bill establishes the Net Energy Billing Cost Stabilization Fund for the purposes of receiving General Fund appropriations for payments for kilowatt-hour credit program costs and commercial and institutional program costs and any overpayments returned by transmission and distribution utilities. LD852 An Act to Reduce the Property Tax Burden by Adequately Funding County Jail Operations This bill amends the laws governing the operation of county jails as follows. 1. It amends the County Jail Operations Fund to provide that, beginning July 1, 2025 and prior to July 1, 2026, state funding must be appropriated annually for the fund in the amount of $25,445,838 plus any additional amount the Legislature may appropriate. Beginning July 1, 2026, state funding must be appropriated annually for that fund in an amount equal to 20% of the total General Fund appropriation to the Department of Corrections for the costs of all correctional facilities under the department plus any additional amount the Legislature may appropriate. Under current law, state funding is required to be appropriated annually for that fund in the amount of $20,342,104. 2. It provides that, in addition to those state funding requirements for the County Jail Operations Fund, beginning July 1, 2026, state funding must be appropriated annually for the fund in an amount equal to 90% of the costs incurred by county jails and the regional jails in the prior fiscal year in complying with the mandatory standards established by the Commissioner of Corrections. 3. It stipulates that, if a county jail fails to report certain information to the department by the end of a fiscal year as required by law, the department shall distribute the quarterly funding payment for that jail under the County Jail Operations Fund between all other jails that are in compliance with the reporting requirement for that quarter. 4. It provides that, in adopting rules and standards for the county jails, the commissioner incorporate the advisory input of the County Corrections Professional Standards Council. Current law only requires the commissioner to consider that advisory input. 5. It amends the law establishing the council to provide that administrative services costs associated with the activities of the council must be paid by the department. Passed
LD343 An Act to Direct the Public Utilities Commission to Seek Informational Bids Regarding Small Modular Nuclear Reactors in the State This bill requires the Public Utilities Commission to annually issue a request for informational bids for the establishment in the State of a small modular nuclear reactor, which is a nuclear reactor that has a rated generating capacity of no more than 350 megawatts, is capable of being constructed and operated at a single site on its own or in combination with one or more nuclear reactors and is required to be licensed by the United States Nuclear Regulatory Commission. The requests are for information only, including the timing for establishing a modular reactor and the cost, location and annual operating costs of a modular reactor, and are not binding on the State or the person submitting the information but may be used in developing a contract. The commission is required to make an annual report to the joint standing committee of the Legislature having jurisdiction over energy and utility matters detailing the informational bids received. The provisions of this legislation are repealed when the State accepts a bid for the establishment of a small modular nuclear reactor. The commission is required to notify the Revisor of Statutes when the State accepts a bid for the establishment of a small modular nuclear reactor. Crossed Over

LD1812 An Act to Establish the Loans for Trade Tools Program This bill, to encourage participation in the trades, does the following. 1. It establishes the Loans for Trade Tools Program, which is a program administered by the Finance Authority of Maine to provide low-interest loans to graduates of a trade program for the purchase of tools and equipment necessary for employment in a trade. Loans are limited to $20,000 and must be repaid within 10 years. If an employee maintains full-time employment, meaning at least 32 hours per week, in the trade, that employee's loan may be forgiven. 2. It establishes a tax credit for employers of employees engaged in a trade for the purchase of tools or equipment needed by that employee within the first year of employment with that employer. The credit is limited to 25% of the amount of the cost of the trade tools and $5,000 per employee, is nonrefundable and may not be carried forward from year to year. 3. It provides an appropriation of $1,000,000 for each year of the 2026-2027 biennium to the Finance Authority of Maine for the Loans for Trade Tools Program. Passed

It requires the Department of Health and Human Services to create and maintain a MaineCare nonemergency transportation dashboard, which is information posted on the department's publicly accessible website reflecting broker performance indicators and results. 2. It requires the department to track nonemergency transportation trips by region and categorize and issue a monthly report regarding all incidents involving the delivery on nonemergency transportation. 3. It establishes the nonemergency transportation ombudsman program as an independent program within the Executive Department to provide ombudsman services to MaineCare members regarding MaineCare nonemergency transportation provided by the department. 4. It requires the department to establish a nonemergency transportation advisory committee in each region to provide the department with recommendations regarding the performance of nonemergency transportation services in that region. LD1888 Resolve, to Study the Establishment of a New Crime of Racketeering for Drug Offenses and Sex Trafficking This bill creates the criminal offense of racketeering, which allows for prosecution of individuals who are members of a racketeering enterprise when 2 or more qualifying criminal acts have been committed by members of the criminal enterprise. Qualifying criminal acts include human trafficking, drug trafficking, illicit marijuana cultivation operations, thefts and financial fraud, gambling and violent acts. The bill provides a mechanism for assets, including money, wrongfully obtained through a racketeering enterprise to be forfeited by amending the criminal asset forfeiture laws. Passed

LD1321 An Act to Reform Net Energy Billing by Establishing Limitations on the Programs' Duration and Compensation This bill does the following. 1. It amends the law governing the kilowatt-hour credit net energy billing program to provide that, unless a distributed generation resource has met the timing requirements established for participation in the program, only distributed generation resources with a nameplate capacity of 20 kilowatts or less may be used for net energy billing. For distributed generation resources participating pursuant to this provision, the number of shared financial interest customers or meters is limited to 10 and a customer may not, at one time, have a financial interest in more than 5 distributed generation resources that have net energy billing arrangements. The bill also provides that kilowatt-hour credits may be credited only to a customer's electricity supply charges. 2. It amends the law governing the tariff rate net energy billing program to limit the tariff rate to the supply rate of the standard-offer service rate. 3. It amends the laws governing the tariff rate and kilowatt-hour credit net energy billing programs to prohibit participation 20 years from the date a net energy billing agreement between the entity proposing the development of the distributed generation resource and the transmission and distribution utility was executed or on December 31, 2045, whichever occurs earlier. The bill also requires a distributed generation resource participating in net energy billing programs to sell in the State renewable energy credits generated by the resource. Dead

Establish a competitive grant program for employers to partner with schools, career and technical education centers and the Maine Community College System to create new training opportunities to address workforce gaps; 8. Develop, in consultation with the Department of Administrative and Financial Services, Bureau of Revenue Services, employer tax incentives for workforce investments; 10. Coordinate with the Department of Labor to address labor shortages in underserved regions by offering temporary housing and commuting or relocation stipends; 11. Conduct audits of workforce education to identify inefficient programs and, upon discovery, reallocate the funds to initiatives with measurable outcomes; and 12. LD1675 An Act to Provide Just Compensation in Cases of Taking by Eminent Domain by Transmission and Distribution Utilities This bill updates the laws regarding damages paid to owners of property taken by eminent domain by a transmission and distribution utility for the construction, rebuilding or relocation of a transmission line. The bill requires a transmission and distribution utility to set aside 1% of the total revenue generated from the construction, rebuilding or relocation of a transmission line annually to be paid as damages to the owner of a property taken by eminent domain for the construction, rebuilding or relocation of that transmission line. The 1% of the revenue set aside for damages must be distributed to property owners based on the acres of property taken from that owner for the construction, rebuilding or relocation of the transmission line in the form of an annual installment over the course of 20 years from the operation date of the transmission line. LD1608 An Act to Counter Unlawful Cannabis Cultivation This bill allows the Department of Administrative and Financial Services to deny a registry identification card or registration certificate to any person who would be authorized under that registration to cultivate cannabis at a geographical location that has been the site of repeated violations under the Maine Medical Use of Cannabis Act or the Cannabis Legalization Act. It allows the department to place a moratorium not to exceed 10 years on such geographical locations for the purpose of issuing or renewing a registration. LD1455 An Act to Prevent Illegal Cannabis Growing Operations in the State This bill amends the definition of "disqualifying drug offense" in the Maine Medical Use of Cannabis Act and in the Maine Revised Statutes, Title 28-B to provide that a conviction that occurred after October 1, 2025 related to the cultivation or distribution of cannabis that is not authorized in the Maine Medical Use of Cannabis Act or in Title 28-B is a disqualifying drug offense. The commission's request for information must also seek identification of existing and near-term replacement energy sources for natural gas in commercial and industrial uses, including when the replacement energy sources are expected to be available, the cost of those replacement energy sources and the steps needed to develop a cost-effective and reliable supply of such replacement energy sources; and 2. Contact every gas utility and natural gas pipeline utility in the State and every state or province adjacent to this State to negotiate favorable terms for one or more energy cost reduction contracts, physical energy storage contracts or such other arrangements as the commission may find necessary or appropriate to reduce the costs of energy in the State and to further reduce greenhouse gas emissions. The commission must submit a report to the Joint Standing Committee on Energy, Utilities and Technology by December 3, 2025 that includes a summary of the responses the commission received from its request for information, any actions taken by the commission as a result of the information received and a summary of actions taken by the commission to negotiate favorable terms for one or more energy cost reduction contracts, physical energy storage contracts or other arrangements. LD1633 An Act to Promote the Recycling and Reuse of Construction Materials This bill directs the Department of Environmental Protection to establish by rule a streamlined process for the certification of construction materials reclamation facilities. Under the bill, a construction materials reclamation facility is defined as a facility that exclusively accepts construction and demolition debris and sorts, refurbishes and sells construction materials reclaimed from the debris for reuse in construction. A construction materials reclamation facility that receives a certification from the department is not required to obtain a solid waste facility license. The bill also establishes the nonlapsing Construction Materials Reclamation Fund within the department to provide grants, loans or other funding to any public or private entity to support the development and certification of construction materials reclamation facilities, training programs for individuals operating and employed at those facilities and public outreach and education initiatives regarding those facilities. Beginning January 1, 2026, this fund will receive a new $10 per ton fee imposed on the landfill disposal of construction and demolition debris and residue from the processing of the debris. The bill also capitalizes this fund with General Fund appropriations of $1 million in fiscal years 2025-26 and 2026-27. The bill establishes a new state goal that, by January 1, 2036, the total tonnage of construction and demolition debris annually disposed of at solid waste landfills in the State will be reduced by 25%. The baseline for calculating this reduction is the 2024 solid waste generation and disposal capacity data gathered by the Department of Environmental Protection. The bill also directs the Department of Administrative and Financial Services, Bureau of Revenue Services to develop a proposal for implementation of a refundable tax credit for housing developers that purchase for use in the construction of affordable housing in the State reclaimed construction materials from a certified construction materials reclamation facility. The credit must be equal to 100% of the documented cost of the reclaimed construction materials purchased by the developer from a construction materials reclamation facility. The bureau is also required to develop a proposal for implementation of a charitable deduction from individual income tax for individuals or businesses who donate construction materials to a certified construction materials reclamation facility. The bureau must submit by January 1, 2026 a report setting forth the tax credit and deduction proposals, including necessary implementing legislation along with any related recommendations, to the Joint Standing Committee on Taxation. After reviewing the report, the committee may report out related legislation to the Second Regular Session of the 132nd Legislature. Dead

The commission must adopt major substantive rules that ensure that the ratepayers of an investor-owned transmission and distribution utility are not responsible for the costs of that investor-owned transmission and distribution utility's generation or generation-related assets except as approved by the commission; require the accounts and records of the investor-owned transmission and distribution utility to be kept separate from the accounts and records associated with any generation or generation-related assets owned by the utility; and protect ratepayers. The commission's rules may also establish standards of conduct applicable to the ownership of generation or generation-related assets by an affiliate of an investor-owned transmission and distribution utility.
