LD852 | An Act to Reduce the Property Tax Burden by Adequately Funding County Jail Operations | This bill amends the laws governing the operation of county jails as follows. 1. It amends the County Jail Operations Fund to provide that, beginning July 1, 2025 and prior to July 1, 2026, state funding must be appropriated annually for the fund in the amount of $25,445,838 plus any additional amount the Legislature may appropriate. Beginning July 1, 2026, state funding must be appropriated annually for that fund in an amount equal to 20% of the total General Fund appropriation to the Department of Corrections for the costs of all correctional facilities under the department plus any additional amount the Legislature may appropriate. Under current law, state funding is required to be appropriated annually for that fund in the amount of $20,342,104. 2. It provides that, in addition to those state funding requirements for the County Jail Operations Fund, beginning July 1, 2026, state funding must be appropriated annually for the fund in an amount equal to 90% of the costs incurred by county jails and the regional jails in the prior fiscal year in complying with the mandatory standards established by the Commissioner of Corrections. 3. It stipulates that, if a county jail fails to report certain information to the department by the end of a fiscal year as required by law, the department shall distribute the quarterly funding payment for that jail under the County Jail Operations Fund between all other jails that are in compliance with the reporting requirement for that quarter. 4. It provides that, in adopting rules and standards for the county jails, the commissioner incorporate the advisory input of the County Corrections Professional Standards Council. Current law only requires the commissioner to consider that advisory input. 5. LD343 | An Act to Direct the Public Utilities Commission to Seek Informational Bids Regarding Small Modular Nuclear Reactors in the State | This bill requires the Public Utilities Commission to annually issue a request for informational bids for the establishment in the State of a small modular nuclear reactor, which is a nuclear reactor that has a rated generating capacity of no more than 350 megawatts, is capable of being constructed and operated at a single site on its own or in combination with one or more nuclear reactors and is required to be licensed by the United States Nuclear Regulatory Commission. The requests are for information only, including the timing for establishing a modular reactor and the cost, location and annual operating costs of a modular reactor, and are not binding on the State or the person submitting the information but may be used in developing a contract. The commission is required to make an annual report to the joint standing committee of the Legislature having jurisdiction over energy and utility matters detailing the informational bids received. The provisions of this legislation are repealed when the State accepts a bid for the establishment of a small modular nuclear reactor. LD1812 | An Act to Establish the Loans for Trade Tools Program | This bill, to encourage participation in the trades, does the following. 1. It establishes the Loans for Trade Tools Program, which is a program administered by the Finance Authority of Maine to provide low-interest loans to graduates of a trade program for the purchase of tools and equipment necessary for employment in a trade. Loans are limited to $20,000 and must be repaid within 10 years. If an employee maintains full-time employment, meaning at least 32 hours per week, in the trade, that employee's loan may be forgiven. 2. It establishes a tax credit for employers of employees engaged in a trade for the purchase of tools or equipment needed by that employee within the first year of employment with that employer. The credit is limited to 25% of the amount of the cost of the trade tools and $5,000 per employee, is nonrefundable and may not be carried forward from year to year. 3. For distributed generation resources participating pursuant to this provision, the number of shared financial interest customers or meters is limited to 10 and a customer may not, at one time, have a financial interest in more than 5 distributed generation resources that have net energy billing arrangements. The bill also provides that kilowatt-hour credits may be credited only to a customer's electricity supply charges. 2. It amends the law governing the tariff rate net energy billing program to limit the tariff rate to the supply rate of the standard-offer service rate. 3. It amends the laws governing the tariff rate and kilowatt-hour credit net energy billing programs to prohibit participation 20 years from the date a net energy billing agreement between the entity proposing the development of the distributed generation resource and the transmission and distribution utility was executed or on December 31, 2045, whichever occurs earlier. Under the bill, a construction materials reclamation facility is defined as a facility that exclusively accepts construction and demolition debris and sorts, refurbishes and sells construction materials reclaimed from the debris for reuse in construction. A construction materials reclamation facility that receives a certification from the department is not required to obtain a solid waste facility license. The bill also establishes the nonlapsing Construction Materials Reclamation Fund within the department to provide grants, loans or other funding to any public or private entity to support the development and certification of construction materials reclamation facilities, training programs for individuals operating and employed at those facilities and public outreach and education initiatives regarding those facilities. Beginning January 1, 2026, this fund will receive a new $10 per ton fee imposed on the landfill disposal of construction and demolition debris and residue from the processing of the debris. The bill also capitalizes this fund with General Fund appropriations of $1 million in fiscal years 2025-26 and 2026-27. The bill establishes a new state goal that, by January 1, 2036, the total tonnage of construction and demolition debris annually disposed of at solid waste landfills in the State will be reduced by 25%. The baseline for calculating this reduction is the 2024 solid waste generation and disposal capacity data gathered by the Department of Environmental Protection. The bill also directs the Department of Administrative and Financial Services, Bureau of Revenue Services to develop a proposal for implementation of a refundable tax credit for housing developers that purchase for use in the construction of affordable housing in the State reclaimed construction materials from a certified construction materials reclamation facility. The credit must be equal to 100% of the documented cost of the reclaimed construction materials purchased by the developer from a construction materials reclamation facility. The bureau is also required to develop a proposal for implementation of a charitable deduction from individual income tax for individuals or businesses who donate construction materials to a certified construction materials reclamation facility. The bureau must submit by January 1, 2026 a report setting forth the tax credit and deduction proposals, including necessary implementing legislation along with any related recommendations, to the Joint Standing Committee on Taxation.
