LD1838 An Act to Provide Opportunities and Sustainable Revenue for Maine Farms, Agricultural Fairs, Wabanaki Tribes and Veterans' Homes This bill authorizes the licensed operation of electronic wagering terminals to place wagers on historical horse races, purchase virtual sealed tickets and to conduct electronic beano by federally recognized Indian tribes, certain off-track betting facilities and commercial tracks and organizations eligible to conduct certain games of chance. Licenses are issued by the director of the Gambling Control Unit within the Department of Public Safety. The bill also requires distributors of electronic wagering terminals to be licensed with the Gambling Control Unit. The bill establishes limits on the number and location of terminals based upon the type of licensee. The bill requires an operator of an electronic wagering terminal to collect 25% of net terminal income for distribution among the General Fund for administrative expenses of the Gambling Control Unit; gambling addiction prevention and treatment services; the Maine Milk Pool until January 1, 2035 and, on or after January 1, 2035, to the Agricultural Development Fund; agricultural fairs; funds dedicated to supporting and promoting harness racing; career and technical education; the Maine Veterans' Homes Stabilization Fund; and municipalities in which terminals are located. LD1783 An Act to Clarify Municipal Affordable Housing Tax Increment Financing This bill makes changes to the laws governing municipal affordable housing development districts, including the following. 1. It amends the law regarding the duration of affordable housing development programs. 2. It changes the costs related to public safety improvements that are considered authorized project costs. 3. It provides for the retention or return of tax increment revenues remaining in an affordable housing development fund on the date a development district ends. 4. These provisions do not apply to transactions conducted remotely by telephone, mail or the Internet. The bill also prohibits a person offering goods or services at retail from posting any sign stating that cash payments are not accepted and from charging a higher price to customers paying with cash instead of by an electronic method. LD1090 Resolve, to Form a Working Group to Address Vacancies in Municipal Government Management Positions This bill directs the Department of Economic and Community Development to convene a working group to study and advise on the challenges faced by municipal governments throughout the State regarding recruiting, retaining and staff development of municipal government management employees. In its work, the working group must consider and develop improvements to the strategies included in the "Maine Economic Development Strategy 2020-2029" report in the context of the municipal government management workforce. Upon completion of its work, the working group must submit its recommendations to the Commissioner of Economic and Community Development for review and make any changes to the working group's proposed improvements that the commissioner determines appropriate. The commissioner must submit the report to the Joint Standing Committee on State and Local Government, and the joint standing committee may report out legislation concerning the report to the Second Regular Session of the 132nd Legislature. LD1973 Resolve, to Establish the Commission to Study Oversight and Funding Structures for Recovery Residences and Resident Protections This resolve establishes the Commission to Study Oversight and Funding Structures for Recovery Residences and Resident Protections. The commission is required to evaluate various policies and industry standards and make policy recommendations with respect to the following: the use of general assistance and the possible expansion or development of new state-funded subsidy programs for use at a recovery residence; alternative models of oversight structure for recovery residences, including voluntary certification, mandatory certification or licensure; and policies related to the use of prescribed medications in recovery residences. The commission is composed of 15 members, including Legislators, the Commissioner of Health and Human Services or the commissioner's designee, the Director of the Office of Policy Innovation and the Future or the director's designee and various other members who have experience with recovery residences, advocating for individuals with substance use disorder or expertise in tenant rights or housing protections for persons with disabilities or substance use disorder. No later than December 3, 2025, the commission is required to submit to the Joint Standing Committee on Health and Human Services a report that includes the commission's findings and recommendations, including any suggested legislation. LD1504 An Act to Support Small Businesses by Providing a Refundable Tax Credit to Certain Businesses to Offset Credit and Debit Card Transaction Fees This bill creates a tax credit for businesses with less than $2,400,000 in gross sales annually that accept credit cards or debit cards for payment and are charged a transaction fee by the issuer of that card. The amount of the tax credit is the amount of the fees the business paid or 2.5% of the sales taxes remitted by that business to the State, whichever is less. The tax credit is refundable. Dead
LD1744 An Act to Modify Provisions of the State Civil Service System Governing Employee Recruitment and Retention This bill makes the following changes to the laws governing recruitment and retention adjustments for state employees in the classified service. 1. It changes one of the criteria for authorizing payment of a recruitment and retention adjustment to add the existence of high turnover or long-term vacancies within a specific department in the relevant occupational classifications or job series. It changes another of the criteria to require that reasonable recruitment and retention efforts have been attempted and have proven ineffective at the current levels of compensation. 2. It provides that payment of a recruitment and retention adjustment may be authorized when an occupational classification is in a job series or job family with an occupational classification entitled to an adjustment and the occupational classification would suffer from either salary compression or salary separation as a result of payment of that adjustment to the other occupational classification. 3. It requires the labor market adjustment to be reviewed at least every 4 years, in alignment with the market pay study conducted by the State. The resulting recruitment and retention adjustment applies to employees hired subsequent to this review. 4. It provides that, if the committee formed to evaluate each request from an agency or bargaining agent for a recruitment and retention adjustment agrees on the appropriate adjustments, the committee must provide a report recommending and documenting those adjustments. If the committee does not agree on the appropriate adjustments, the matter must be submitted to a neutral 3rd party for a final decision and report. 5. It requires the Department of Administrative and Financial Services, Bureau of Human Resources to prescribe the forms to be filed with the bureau to request a recruitment and retention adjustment. 6. It removes language that authorizes payment of a recruitment and retention adjustment when the relevant occupational classification or job series has a clear, geographically definable labor market within which the State must compete. 7. It provides that if the committee that reviews adjustments agrees on the appropriate adjustment, the committee must provide the appropriate persons with a report recommending and documenting the adjustments. LD849 An Act to Establish a Recall Process for Public School Board Members This bill provides that public school board members may be recalled only for specified behavior or misconduct and may not be recalled for the performance of a required duty or a discretionary duty. The petition to recall the school board member must be signed by at least 25% of the voters who voted in the last gubernatorial election in the municipality or, if the school board member was elected as a school board member-at-large, by at least 25% of the voters who voted in the school administrative unit in the last gubernatorial election. The recall must be approved by a majority of voters in an election in which the total number of ballots is at least 35% of the number of votes cast in the municipality or, if applicable, the school administrative unit in the last gubernatorial election. LD1975 An Act to Eliminate the ConnectMaine Authority by Repealing the Advanced Technology Infrastructure Act This bill repeals the Advanced Technology Infrastructure Act, which is codified as the Maine Revised Statutes, Title 35-A, chapter 93. Repeal of this chapter eliminates the state broadband policy, the ConnectMaine Authority, the ConnectMaine Fund and the Municipal Gigabit Broadband Network Access Fund. LD1743 An Act to Allow Municipalities to Prohibit Firearms Within Their Municipal Buildings and Voting Places and at Their Municipal Public Proceedings This bill permits a municipality to adopt an order, ordinance, policy or regulation that limits or prohibits the possession of firearms within its buildings and voting places and at municipal public proceedings within the municipality; if adopted, the order, ordinance, policy or regulation may impose a civil penalty of not more than $1,000 per violation. The bill provides an exception to allow a federal, state, county or local law enforcement officer to possess firearms in a municipality's buildings and voting places and at municipal public proceedings within the municipality. If a municipality adopts such an order, ordinance, policy or regulation, it is required to post, in a prominent location outside of all buildings and other places to which the order, ordinance, policy or regulation applies, notice of the limitation or prohibition against the possession of firearms, including any adopted exceptions to the limitation or prohibition. For a municipal public proceeding that is conducted in a part of a nonmunicipal building, the limitation or prohibition does not extend to those nonmunicipal parts or users of the building. The bill also establishes a definition for "municipal public proceeding." In Committee
LD1388 An Act to Replace the Participation Threshold in Votes to Adopt or Alter a Municipal Charter with a Lower Approval Threshold This bill changes the requirements for a new municipal charter, charter revision, charter modification or charter amendment in a question before the voters to go into effect. Current law requires that the total number of votes cast for and against the question equals or exceeds 30% of the total votes cast in the municipality in the last gubernatorial election. The bill requires instead that the number of votes cast in favor of the question equals or exceeds 15% of the total votes cast in the municipality in the last gubernatorial election. Also, while this bill does not change the requirement that a majority of votes cast for and against the proposed change be in favor of it in order for that change to go into effect, it clarifies that blank votes are not counted in that calculation. LD644 An Act to Expand Employment Opportunities for Minor Students by Eliminating Certain Work Limitations This bill repeals the provisions of law specifying that a minor 16 or 17 years of age may not work: 1. More than 50 hours in any week when the minor's school is not in session; 2. More than 24 hours in any week when the minor's school is in session; 3. More than 6 hours in any day when the minor's school is in session; 4. More than 10 hours in any day when the minor's school is not in session; 5. More than 6 consecutive days; 6. After 10:15 p.m. on a day preceding a day on which the minor's school is in session or after 12 midnight on a day that does not precede such a school day; or 7. Before 7 a.m. on a day on which the minor's school is in session or before 5 a.m. on any other day. The bill also repeals the provision of law specifying that a minor under 17 years of age may not be employed during the hours that the public schools of the town or city in which the minor resides are in session. LD1600 An Act to Provide Regional Support Funding for Municipal Police Departments to Support Special Response Teams This bill creates the Special Response Team Fund to reimburse municipalities that maintain and operate special response teams, which are elite tactical law enforcement teams certified by the Maine Criminal Justice Academy that rapidly respond to high-risk law enforcement operations and conduct criminal investigations that exceed the capabilities of standard law enforcement agencies and require specialized training, equipment and tactics. The bill requires each county to contribute annually a pro rata share based upon population of an amount equal to refund 10% of the previous calendar year's expenses that each municipality spent to maintain and operate a special response team.
