Establishing, putting forward, or implementing a fee schedule that the payment card network knows, or reasonably should know, has been used by a covered credit card issuer other than the payment card network to determine the amount of an interchange fee charged or received by the covered credit card issuer in the current or previous calendar year; ! Establishing, charging, or putting forward on a fee schedule an interchange fee if the fee includes a percentage multiplied by the amount of a transaction and the fee does not exclude any amount attributable to a tax or gratuity on the transaction, or increasing fees in an attempt to or in a manner that would circumvent such interchange fee prohibition; ! Requiring a merchant that accepts credit cards that are enabled for processing over the payment card network to accept all credit cards issued by a covered credit card issuer that are enabled for processing over the payment card network; ! Distributing, publishing, or otherwise using data from an electronic payment transaction, except in certain circumstances; ! Charging a fee to a consumer or merchant related to a disputed credit card transaction until the dispute has been resolved and the consumer or merchant has been provided written notice of the determination; or ! Imposing a penalty on a merchant for setting prices in a manner that complies with state and federal law. The bill prohibits a payment card network from establishing, putting forward, or implementing a fee schedule that the payment card network knows or reasonably should know has been used by one or more issuers other than the payment card network to determine the amount of an interchange fee received or charged in respect to a charitable contribution, unless the interchange fee does not exceed: ! 0.2% of the amount of a charitable contribution made by means of a debit card; or ! 0.3% of the amount of a charitable contribution made by means of a credit card. If a payment card network violates the act, a merchant, consumer, or other individual or entity that is injured as a result may bring a civil action. A payment card network that is found to have violated the act as a result of a civil action other than a certified class action is liable in an amount equal to the sum of: ! The greater of: ! The amount of actual damages sustained plus interest; or ! $500; or ! times the amount of actual damages sustained if the payment card network engaged in bad faith conduct; plus ! The costs of the action plus reasonable attorney fees. HB1253 | Youth Health Protection Act | The bill prohibits an individual to perform or cause or assist in the performance of any medical procedure or medical treatment that furthers a minor's desire to present or appear in a manner that is inconsistent with the minor's sex. The bill prohibits an office, agency, political subdivision of this state, or organization with the authority to license or discipline members of a profession from imposing a penalty or taking adverse action against an individual who provides or receives counseling, advice, or guidance consistent with conscience or religious belief. The bill allows the parent, guardian, or legal custodian of a minor to withhold consent for treatment, activity, or mental health-care service that is designed and intended to form the parent's child's conceptions of sex and gender or to treat gender dysphoria or gender nonconformity. The bill prohibits a law enforcement officer acting pursuant to an investigation, an employee, an agent of this state, or a political subdivision from encouraging a minor to withhold information from the minor's parent or from withholding information regarding a minor's physical or mental health from the minor's parent. The bill prohibits a person from being discriminated or retaliated against by a person who provides information regarding an act or omission that violates the requirements described in the bill. The bill prohibits the state from using state funds for the performance of, or in furtherance of, any medical procedure or medical treatment that furthers a minor's desire to present or appear in a manner that is inconsistent with the minor's sex. HB1216 | State Agencies Implement Zero-Based Budgeting | In state fiscal year 2026-27, the bill requires the department of revenue, the department of education, and the department of transportation to implement a budgeting method in which all expenses, both existing and new, must be justified for the fiscal year and every function is analyzed for its needs and costs (zero-based budgeting) when submitting a budget request. In state fiscal year 2027-28 and each state fiscal year thereafter, the bill requires all state agencies in all principal departments to implement zero-based budgeting when submitting a budget request. In state fiscal year 2026-27 and each state fiscal year thereafter, the office of state planning and budgeting is required to develop and digitally distribute to state agencies information related to zero-based budgeting training and to provide virtual sessions for the purpose of training state agencies to implement zero-based budgeting. The bill adds language to the existing theft statute clarifying how a gift card's value is determined for purposes of determining the offense level and associated penalty. If the stolen item of value is a gift card, then the value is the full monetary face value or, in the case of a variable load gift card, the maximum potential value, regardless of whether funds have been transferred to the gift card at the time of the theft. Examining every state-funded state agency and state department's operations, personnel, and mission to determine whether the state agency or state department is maximizing the efficient use of state money and resources; ! Identifying efficiencies in state government that would result in cost savings and improved provision of government services; ! Working with the federal government to implement federal directives designed to increase government efficiency and reduce government costs; ! Providing recommendations to the governor and general assembly about implementing efficiencies in state government, leveraging money from the federal government, and implementing federal directives; ! Holding public hearings that solicit input from the public about increasing efficiencies in state government; and ! Developing a process for members of the public to make ongoing recommendations related to state government efficiency, which recommendations will be reviewed by the authority. The authority may accept gifts, grants, donations, and federal money to pay for the authority's operations. The authority is not funded by a state agency or state department. | Dead |
HB1164 | Constitutional Carry of Handgun | The bill grants a person who is at least 18 years of age and permitted to possess a handgun pursuant to federal and state law the same authority to carry a concealed handgun as a person who holds a permit to carry a concealed handgun (permit). A person who carries a concealed handgun without a permit has the same rights, limitations, and authority to carry as a person who holds a permit. A person may obtain a permit for the purpose of using the permit to carry a concealed handgun in another state that recognizes a Colorado permit. The bill makes the minimum age to obtain a permit 18 years of age. Under existing law, Colorado recognizes permits issued in other states that meet certain criteria, including that the holder of the out-of-state permit is at least 21 years of age. The bill changes the minimum age for recognition of an out-of-state permit to 18 years of age. Under existing law, a permit is valid for 5 years. The bill makes a permit valid for the life of the permit holder. Existing permits, other than temporary emergency permits, are converted to lifetime permits. Because the bill makes permits valid for the life of the holder, the bill repeals provisions relating to the renewal of permits. The bill repeals the temporary emergency permit to carry a concealed handgun. The bill repeals local government authority to regulate open or concealed carry of a handgun, including repealing the authority of special districts and the governing boards of institutions of higher education, as applicable. | Dead |
