HB1069 Increase Stakeholder Participation The bill creates a process and establishes a public online forum for a member of the general assembly to publish drafts or titles of the bills that the member is considering introducing during the next legislative session. The bill allows each member to post multiple bill titles, drafts, or a combination of titles and drafts on the online forum and establishes a timeline for a member to publish up to 3 versions of each bill title or draft. HB1282 Payment Card Network Practices & Fees The bill enacts the "Swipe Fee Fairness and Consumer Safeguards Act" (act), which prohibits a payment card network from: ! Fixing or conspiring to fix an interchange fee with, or on behalf of, a covered credit card issuer or another payment card network; ! Establishing, putting forward, or implementing a fee schedule that the payment card network knows, or reasonably should know, has been used by a covered credit card issuer other than the payment card network to determine the amount of an interchange fee charged or received by the covered credit card issuer in the current or previous calendar year; ! Establishing, charging, or putting forward on a fee schedule an interchange fee if the fee includes a percentage multiplied by the amount of a transaction and the fee does not exclude any amount attributable to a tax or gratuity on the transaction, or increasing fees in an attempt to or in a manner that would circumvent such interchange fee prohibition; ! Requiring a merchant that accepts credit cards that are enabled for processing over the payment card network to accept all credit cards issued by a covered credit card issuer that are enabled for processing over the payment card network; ! Distributing, publishing, or otherwise using data from an electronic payment transaction, except in certain circumstances; ! Charging a fee to a consumer or merchant related to a disputed credit card transaction until the dispute has been resolved and the consumer or merchant has been provided written notice of the determination; or ! Imposing a penalty on a merchant for setting prices in a manner that complies with state and federal law. The bill prohibits a payment card network from establishing, putting forward, or implementing a fee schedule that the payment card network knows or reasonably should know has been used by one or more issuers other than the payment card network to determine the amount of an interchange fee received or charged in respect to a charitable contribution, unless the interchange fee does not exceed: ! 0.2% of the amount of a charitable contribution made by means of a debit card; or ! 0.3% of the amount of a charitable contribution made by means of a credit card. If a payment card network violates the act, a merchant, consumer, or other individual or entity that is injured as a result may bring a civil action. A payment card network that is found to have violated the act as a result of a civil action other than a certified class action is liable in an amount equal to the sum of: ! The greater of: ! The amount of actual damages sustained plus interest; or ! $500; or ! times the amount of actual damages sustained if the payment card network engaged in bad faith conduct; plus ! The costs of the action plus reasonable attorney fees. If a payment card network is found liable in a certified class action, a successful plaintiff may recover actual damages, injunctive relief allowed by law, and reasonable attorney fees and costs. HB1253 Youth Health Protection Act The bill prohibits an individual to perform or cause or assist in the performance of any medical procedure or medical treatment that furthers a minor's desire to present or appear in a manner that is inconsistent with the minor's sex. The bill prohibits an office, agency, political subdivision of this state, or organization with the authority to license or discipline members of a profession from imposing a penalty or taking adverse action against an individual who provides or receives counseling, advice, or guidance consistent with conscience or religious belief. The bill allows the parent, guardian, or legal custodian of a minor to withhold consent for treatment, activity, or mental health-care service that is designed and intended to form the parent's child's conceptions of sex and gender or to treat gender dysphoria or gender nonconformity. The bill prohibits a law enforcement officer acting pursuant to an investigation, an employee, an agent of this state, or a political subdivision from encouraging a minor to withhold information from the minor's parent or from withholding information regarding a minor's physical or mental health from the minor's parent. The bill prohibits a person from being discriminated or retaliated against by a person who provides information regarding an act or omission that violates the requirements described in the bill. The bill prohibits the state from using state funds for the performance of, or in furtherance of, any medical procedure or medical treatment that furthers a minor's desire to present or appear in a manner that is inconsistent with the minor's sex. The bill allows an individual harmed or aggrieved by a violation of the requirements described in the bill to file suit and recover certain damages and civil remedies. Dead
HB1216 State Agencies Implement Zero-Based Budgeting In state fiscal year 2026-27, the bill requires the department of revenue, the department of education, and the department of transportation to implement a budgeting method in which all expenses, both existing and new, must be justified for the fiscal year and every function is analyzed for its needs and costs (zero-based budgeting) when submitting a budget request. In state fiscal year 2027-28 and each state fiscal year thereafter, the bill requires all state agencies in all principal departments to implement zero-based budgeting when submitting a budget request. In state fiscal year 2026-27 and each state fiscal year thereafter, the office of state planning and budgeting is required to develop and digitally distribute to state agencies information related to zero-based budgeting training and to provide virtual sessions for the purpose of training state agencies to implement zero-based budgeting. In state fiscal year 2027-28 and each state fiscal year thereafter, the office of state planning and budgeting is required to submit to the general assembly an annual report detailing the effectiveness of zero-based budgeting. All budget requests that implement zero-based budgeting must be publicly accessible on the general assembly's website, and the state auditor is required to conduct periodic financial audits to ensure state agencies' compliance with zero-based budgeting requirements. HB1055 Repeal Firearm Dealer Requirements & State Permit The bill repeals the requirements related to dealing firearms enacted in House Bill 24-1353, including repealing the following: ! The requirement for a firearms dealer (dealer) to obtain a state firearms dealer permit (state permit) to engage in the business of dealing in firearms on and after July 1, 2025; ! The requirement for the department of revenue to conduct on-site inspections of state permit holders; ! The requirement that a dealer secure firearms in a manner that prevents members of the public from accessing the firearms; ! Specific requirements for a dealer to report to law enforcement about suspected straw purchases and firearm thefts by employees; ! The prohibition on a dealer selling or transferring a firearm outside of the dealer's posted business hours or to a person who is under the influence of alcohol or a controlled substance; ! The requirement for each dealer and each employee of a dealer whose position involves handling firearms to annually complete a training course; and ! Minimum qualifications for employees of dealers and the requirement for employees to submit to background checks. Dead

HB1141 Gift Card & Retail Property Crime Penalties Current law requires mandatory sentencing to at least the minimum of the prescribed range for a person who, within the immediately preceding 4 years, was twice convicted of felony theft from a store and who is once again convicted of felony theft from a store. The bill requires a state court to sentence a person convicted of burglary, robbery, theft, or a related property crime from or of a store, who was convicted of any 2 of the specified property crimes or comparable municipal offenses from or of a store within the preceding 4 years, to at least the midpoint term for the current offense. The bill adds language to the existing theft statute clarifying how a gift card's value is determined for purposes of determining the offense level and associated penalty. If the stolen item of value is a gift card, then the value is the full monetary face value or, in the case of a variable load gift card, the maximum potential value, regardless of whether funds have been transferred to the gift card at the time of the theft. The bill adds gift cards to the list of written instruments subject to forgery. Dead
SB047 Enforcement of Federal Immigration Law In 2006, the general assembly passed Senate Bill 06-090, which: ! Prohibited a local government from passing any ordinance or policy that would prohibit a police officer, local official, or local government employee from cooperating with federal officials with regard to the immigration status of a person within the state; ! Required a peace officer who has probable cause to believe that a person is not legally present in the United States to report the person to the federal immigration and customs enforcement office; ! Required each local government to provide notice to peace officers of the duty to report and to provide written confirmation of the notice and reporting statistics to the general assembly; and ! Prohibited a local government that violates this provision from receiving any grants administered by the department of local affairs. Senate Bill 06-090 was repealed in 2013. The bill recreates and reenacts Senate Bill 06-090. Current law prohibits: ! A person from being arrested while the person is present at a courthouse, or while going to, attending, or coming from a court proceeding, and provides remedies for a violation; ! A probation officer or probation department employee from providing personal information about an individual to federal immigration authorities; and ! State and local governmental entities from contracting with a private entity for immigration detention services or entering into agreements for immigration detention services. The bill repeals each of these laws. Dead
SB135 Colorado Government Efficiency Authority The bill creates the Colorado government efficiency authority (authority). The authority is governed by a board consisting of the following appointees: ! One representative of the private sector with business experience with state contracts, appointed by the governor; ! One representative of the private sector with experience as a chief financial officer or legal advisor, appointed by the speaker of the house of representatives; ! One representative of the private sector with experience in energy and environmental work, appointed by the president of the senate; ! One representative of the private sector with experience in transportation, appointed by the minority leader of the house of representatives; ! One representative of the private sector with experience in health care or real estate, appointed by the minority leader of the senate; ! The staff director of the joint budget committee, or the staff director's designee, as a nonvoting advisory member; ! The director of the office of state planning and budgeting, or the director's designee, as a nonvoting advisory member; and ! The state auditor, or the state auditor's designee, as a nonvoting advisory member. Members of the board serve without compensation for any service provided to the authority and do not receive any reimbursement from the board for expenses incurred in furtherance of the board's responsibilities. The board is charged with: ! Examining every state-funded state agency and state department's operations, personnel, and mission to determine whether the state agency or state department is maximizing the efficient use of state money and resources; ! Identifying efficiencies in state government that would result in cost savings and improved provision of government services; ! Working with the federal government to implement federal directives designed to increase government efficiency and reduce government costs; ! Providing recommendations to the governor and general assembly about implementing efficiencies in state government, leveraging money from the federal government, and implementing federal directives; ! Holding public hearings that solicit input from the public about increasing efficiencies in state government; and ! Developing a process for members of the public to make ongoing recommendations related to state government efficiency, which recommendations will be reviewed by the authority. The authority may accept gifts, grants, donations, and federal money to pay for the authority's operations. The authority is not funded by a state agency or state department. Dead
HB1164 Constitutional Carry of Handgun The bill grants a person who is at least 18 years of age and permitted to possess a handgun pursuant to federal and state law the same authority to carry a concealed handgun as a person who holds a permit to carry a concealed handgun (permit). A person who carries a concealed handgun without a permit has the same rights, limitations, and authority to carry as a person who holds a permit. A person may obtain a permit for the purpose of using the permit to carry a concealed handgun in another state that recognizes a Colorado permit. The bill makes the minimum age to obtain a permit 18 years of age. Under existing law, Colorado recognizes permits issued in other states that meet certain criteria, including that the holder of the out-of-state permit is at least 21 years of age. The bill changes the minimum age for recognition of an out-of-state permit to 18 years of age. Under existing law, a permit is valid for 5 years. The bill makes a permit valid for the life of the permit holder. Existing permits, other than temporary emergency permits, are converted to lifetime permits. Because the bill makes permits valid for the life of the holder, the bill repeals provisions relating to the renewal of permits. The bill repeals the temporary emergency permit to carry a concealed handgun. The bill repeals local government authority to regulate open or concealed carry of a handgun, including repealing the authority of special districts and the governing boards of institutions of higher education, as applicable. HB1143 Open-Source Software in Voting Systems Beginning January 1, 2027, the bill requires any voting system used in an election in the state to use open-source software that allows a voting system provider to incorporate end-to-end verifiability into its voting systems. The secretary of state is required to adopt rules to establish minimum standards for the certification and oversight of any open-source software used in a voting system, and each county is required to ensure that open-source software is incorporated into its voting system within the county's existing resources. Beginning in January 2028, and in January every year thereafter, the secretary of state is required to include information regarding the incorporation of open-source software in voting systems as part of the secretary's presentation at a "SMART Act" hearing.
