HB1260 Electrical Generation & Distribution Resiliency The bill requires the public utilities commission (commission) to evaluate electrical generation and grid resilience against geomagnetic storms (evaluation) and report the findings of the evaluation to the general assembly. The bill sets standards for the evaluation. Based on the evaluation, the commission shall adopt rules requiring an electrical utility to meet resiliency standards for geomagnetic storms. The rules include: ! HB1253 Youth Health Protection Act The bill prohibits an individual to perform or cause or assist in the performance of any medical procedure or medical treatment that furthers a minor's desire to present or appear in a manner that is inconsistent with the minor's sex. The bill prohibits an office, agency, political subdivision of this state, or organization with the authority to license or discipline members of a profession from imposing a penalty or taking adverse action against an individual who provides or receives counseling, advice, or guidance consistent with conscience or religious belief. The bill allows the parent, guardian, or legal custodian of a minor to withhold consent for treatment, activity, or mental health-care service that is designed and intended to form the parent's child's conceptions of sex and gender or to treat gender dysphoria or gender nonconformity. The bill prohibits a law enforcement officer acting pursuant to an investigation, an employee, an agent of this state, or a political subdivision from encouraging a minor to withhold information from the minor's parent or from withholding information regarding a minor's physical or mental health from the minor's parent. The bill prohibits a person from being discriminated or retaliated against by a person who provides information regarding an act or omission that violates the requirements described in the bill. The bill prohibits the state from using state funds for the performance of, or in furtherance of, any medical procedure or medical treatment that furthers a minor's desire to present or appear in a manner that is inconsistent with the minor's sex. The bill allows an individual harmed or aggrieved by a violation of the requirements described in the bill to file suit and recover certain damages and civil remedies. Dead

HB1196 Landlord Procedures for Removal of Tenants Under current law, based on a tenant's failure to pay one or more late fees, a landlord cannot: ! Remove or exclude a tenant from a dwelling; ! Terminate a tenancy or other estate at will; or ! Terminate a lease in a mobile home park. The bill clarifies that a landlord can take such actions if there is another legal reason and the landlord is not taking the action solely because the landlord is owed one or more late fees. Additionally, a landlord cannot issue a written demand notice for a tenant to give up possession of the premises (demand letter) based solely on the tenant's failure to pay one or more late fees, but must have another legal reason to issue the demand letter. Under current law, the demand letter must be written in English, Spanish, or any other language that the landlord knows, or has reason to know, is the primary language of the tenant. The bill instead requires that the demand letter must be written in English or, if requested by the tenant at the time the tenant enters into the lease, in another language that is the tenant's primary language. Under current law, a landlord is permitted to post a notice to vacate in a conspicuous place on the premises after at least one unsuccessful attempt at service on 2 separate days. The bill allows the landlord to post the notice in a conspicuous place on the premises after only one unsuccessful attempt to serve the tenant with the notice. Dead
HB1141 Gift Card & Retail Property Crime Penalties Current law requires mandatory sentencing to at least the minimum of the prescribed range for a person who, within the immediately preceding 4 years, was twice convicted of felony theft from a store and who is once again convicted of felony theft from a store. The bill requires a state court to sentence a person convicted of burglary, robbery, theft, or a related property crime from or of a store, who was convicted of any 2 of the specified property crimes or comparable municipal offenses from or of a store within the preceding 4 years, to at least the midpoint term for the current offense. The bill adds language to the existing theft statute clarifying how a gift card's value is determined for purposes of determining the offense level and associated penalty. If the stolen item of value is a gift card, then the value is the full monetary face value or, in the case of a variable load gift card, the maximum potential value, regardless of whether funds have been transferred to the gift card at the time of the theft. The bill adds gift cards to the list of written instruments subject to forgery. Dead
HB1164 Constitutional Carry of Handgun The bill grants a person who is at least 18 years of age and permitted to possess a handgun pursuant to federal and state law the same authority to carry a concealed handgun as a person who holds a permit to carry a concealed handgun (permit). A person who carries a concealed handgun without a permit has the same rights, limitations, and authority to carry as a person who holds a permit. A person may obtain a permit for the purpose of using the permit to carry a concealed handgun in another state that recognizes a Colorado permit. The bill makes the minimum age to obtain a permit 18 years of age. Under existing law, Colorado recognizes permits issued in other states that meet certain criteria, including that the holder of the out-of-state permit is at least 21 years of age. The bill changes the minimum age for recognition of an out-of-state permit to 18 years of age. Under existing law, a permit is valid for 5 years. The bill makes a permit valid for the life of the permit holder. Existing permits, other than temporary emergency permits, are converted to lifetime permits. Because the bill makes permits valid for the life of the holder, the bill repeals provisions relating to the renewal of permits. The bill repeals the temporary emergency permit to carry a concealed handgun. The bill repeals local government authority to regulate open or concealed carry of a handgun, including repealing the authority of special districts and the governing boards of institutions of higher education, as applicable. HB1231 Protect Minors from Sexual or Pornographic Content The bill prohibits an individual, organization, or entity from: ! Permitting a minor to attend events, performances, or activities explicitly involving sexual content or pornographic materials; or ! Exposing a minor to pornographic materials in any form, including digital, print, or broadcast mediums. The prohibition does not apply to: ! Educational materials or school programs explicitly designed for age-appropriate sex education in accordance with local and federal regulations; or ! Parental or guardian discussions about sexual health and development appropriate to the child's maturity level. A violation is an unclassified misdemeanor, and for the first violation the penalty is a fine of up to $10,000. A second or subsequent violation is subject to a sentence of up to 2 years in jail. A violator is also subject to revocation of a business license if the violator is an establishment that knowingly permits such exposure. Dead

SB074 Highly Specialized Employment Leave Protection Exemption Under current law, when an employee takes leave from a job pursuant to the state's paid family and medical leave insurance program, the employer is required to hold the employee's job until the employee returns and maintain the employee's health-care benefits during the duration of their leave. Section 1 of the bill creates an exemption from these requirements for an employer that has a workforce of 51% or more highly specialized employees. The bill requires an employer to apply to and get approval from the division of family and medical leave insurance (division) in the department of labor and employment before the employer can qualify for the exemption. An employer that qualifies must reapply annually to maintain the exemption. Lastly, section 1 defines a highly specialized employee as an employee whose job description or duties: ! Involve responsibilities that are not easily transferrable; ! Require a specific or unique advanced degree that limits the pool of replacements; or ! Require a rare or in-high-demand skill set. Section 2 requires the division to establish a standardized application process for employers to apply for the highly specialized employees exemption by submitting documentation that proves that the employer has a workforce of 51% or more highly specialized employees. On or before March 1, 2026, the director of the division is required to adopt necessary rules to implement the application process. Dead
