The nuisance and trespass protection for an agricultural activity would not apply whenever a nuisance or trespass violation results from the negligent operation of an agricultural activity or from a violation of the State agricultural water quality requirements. The bill would also provide that an agricultural activity shall not lose nuisance or trespass protection due to a change of ownership or a cessation of operation of not more than five years; a change of crops produced; or a change of a farming method or conversion of a farming practice or agricultural activity to another farming method, practice, S.45 or agricultural activity on a farm. The act would also provide that a person shall not bring a court action based on a claim of nuisance or trespass arising from an agricultural activity unless the person and the operator of the agricultural activity, at least once, attempt to resolve through mediation the issue or dispute that the person has concerning operation of the agricultural activity. Whereas, the State of Vermont is fully committed to ensuring the enforcement of the rights of individuals with disabilities and the provision of inclusive services and person-centered systems of care, and Whereas, individuals with autism contribute their talents, perspectives, and problem-solving abilities to strengthen Vermont’s workforce; enrich families and communities; and advance innovation in science, technology, the arts, and beyond, and Whereas, autism is a neurological difference, not a disease or an epidemic, and Whereas, the rising autism identification rates, which trained clinicians and health care professionals are documenting, are attributable to improved diagnostic practices, greater awareness of autism, and expanded access to screening tools, and Whereas, individuals with disabilities, including individuals with autism, are too often stigmatized and underestimated, and public policy should never diminish the diverse strengths and potential of these Vermonters, and Whereas, the Secretary of the U.S. Department of Health and Human Services, Robert F. Kennedy Jr., has announced plans to establish a federal research database intended to be used to investigate the root causes of autism, and Whereas, this new database will be a compilation of information derived from individuals’ insurance claims; electronic medical records; and wearable devices, such as smart watches, and Whereas, although this new database is no longer characterized as an “autism registry,” as Secretary Kennedy and National Institutes of Health Director, Dr. Jay Bhattacharya, had previously announced, and despite public promises of personal and medical privacy, significant concerns remain regarding the potential use of Vermonters’ sensitive, personally identifiable health care information without their specific and informed consent, and Whereas, the Governor of the State of Illinois has issued Executive Order 2025-02 (the EO) to ensure that Illinois state officials fully comply with all applicable state and federal legal privacy protections in matters affecting the collection and use of information of persons being tested for, or who have been diagnosed with, autism, or in any database that now or may in the future exist that includes personal information related to autism; that the information not be collected, unless dong so is strictly necessary for authorized purposes; and that the information not be disclosed outside state government except if one of the conditions listed in the EO is met, and Whereas, it is imperative that Vermont officials are similarly vigilant in their protection of personal data being collected for any type of analysis or assessment related to autism, now therefore be it In Committee

Whereas, according to the USDA Animal and Plant Health Inspection Service (APHIS), there is an HPAI (highly pathogenic avian influenza) H5N1 virus present worldwide and outbreaks among U.S. domestic birds (including poultry) are continuing to occur, and Whereas, as of April 9, 2025, the CDC reported that HPAI H5N1 had stricken 168,771,718 birds in commercial, hobbyist, and backyard poultry flocks in 1,680 outbreaks across the country, and Whereas, the severity of this avian flu outbreak cannot be minimized, and Whereas, to date, the CDC has assessed that HPAI H5N1 poses a low risk to humans, but nonetheless, one person has died, 70 cases have been reported, and the potential for additional human impact cannot be ignored, and Whereas, APHIS has created a five-prong set of responses to the animal health crisis encompassing investment in gold-standard biosecurity measures for all U.S. poultry; increased relief to aid farmers and acceleration of repopulation; removal of unnecessary regulatory burdens on the chicken and egg industry to further innovation and reduce customer prices; the exploration of pathways toward vaccines, therapeutics, and other strategies for the protection of egg-laying chickens to reduce instances of depopulation; and the consideration of temporary import-export options to reduce costs and the evaluation of international best practices, and Whereas, although these steps attempt to address aspects of the continuing presence of the HPAI H5N1 avian virus in the nation’s poultry flocks, there must be a more comprehensive and direct measure to halt the spread and reduce, if not eliminate, the presence of the virus, and Whereas, on February14, 2025, the USDA issued a conditional license to Zoetis for an avian influenza vaccine, H5N2 Subtype, Killed Virus, intended for use in chickens, and Whereas, although the approval is conditioned on the “demonstration of safety, purity, and reasonable expectation of efficacy based on serology data,” the need for this vaccine is immediate, and Whereas, this new Zoetis vaccine is an updated version of a vaccine originally issued in 2001 and 2002, when an avian influenza outbreak occurred in Southeast Asia, and Whereas, in 2014 and 2015, during a prior avian flu outbreak, the federal government created a national avian flu vaccine stockpile, which, while not used, was ready for deployment, and Whereas, the rapid federal distribution of COVID-19 vaccines demonstrates that, with the necessary planning, the complex logistics required for an accelerated national stockpiling/deployment of an avian flu vaccine is possible, and Whereas, the continuing avian flu crisis and its impact on commercial, hobby, and backyard poultry flocks demands a decisive and prompt federal response, now therefore be it Signed/Enacted/Adopted

Whereas, the United States and the Republic of China (Taiwan) share a vibrant, mutually beneficial bilateral relationship based on our common values of freedom and a free-market economy, and the relationship is as strong as it has ever been, and Whereas, the January 2024 election of Dr. Lai Ching-te as the President of Taiwan demonstrates the vibrancy of Taiwan’s democracy, and Whereas, the United States is Taiwan’s second-largest trading partner and Taiwan is the United States’ seventh- largest trading partner; in 2024, the two-way trade in goods between the United States and Taiwan totaled in excess of $157 billion; and the United States is also the largest supplier of agricultural products to Taiwan, and Whereas, in 2022, the United States and Taiwan launched, and in 2023 signed, the U.S.-Taiwan Initiative on 21st Century Trade, which, in part, “is intended to develop concrete ways to deepen the economic and trade relationship,” and the first agreement under the Initiative became effective in December 2024, and Whereas, Taiwan is the second-largest export destination for Vermont goods, worth approximately $254 million, and Vermont imported an estimated $55.3 million in goods from Taiwan, and Whereas, the Government of Taiwan has expressed a desire to reach an avoidance of double taxation agreement with the United States, which could increase Vermont’s exports to Taiwan, bilateral investment, and jobs in Vermont, and Whereas, Vermont and Taiwan have enjoyed a long history of productive bilateral relations, including entering into a driver’s license reciprocity agreement in 2020, and the Government of Taiwan desires to establish a memorandum of understanding with the State of Vermont to further increase educational exchanges and cooperation, and Whereas, United States policy toward Taiwan is not based on United Nations Resolution 2758 of 1971, but rather the Taiwan Relations Act of 1979, which “provides for the continued membership of the people on Taiwan in any international financial institution or any other international organization,” and Whereas, Taiwan’s participation and contributions in international organizations, such as the International Civil Aviation Organization, the World Health Organization, and the United Nations Framework Convention on Climate Change would greatly benefit both the United States and the international community, now therefore be it Signed/Enacted/Adopted

S0075 An act relating to transportation initiatives to improve equity and infrastructure, increase resiliency, and reduce emissions This bill proposes to do the following: (1) appropriate funds for the Incentive Program for New Plug-in Electric Vehicles; the MileageSmart Incentive Program, the Replace Your Ride Program, and the eBike Incentive Program; (2) provide additional State funding for local public transit agencies in fiscal year 2026 to ensure that agencies maintain the existing level of service; (3) impose a fee on retail deliveries that are subject to the sales and use tax; (4) create a revenue-neutral system of motor vehicle efficiency fees and motor vehicle efficiency rebates; (5) require the Agency of Transportation to implement public outreach campaigns related to public transportation, active transportation, electric vehicles, idling, and safe passing distances; (6) provide funding to the Agency of Transportation to enhance public-private partnerships promoting electric S.75 vehicles and eBikes; (7) require the Agency of Transportation to consider reductions in vehicle miles traveled and greenhouse gas emissions reductions when evaluating projects; (8) reduce the local share due from smaller municipalities seeking State funding for projects; (9) direct the Agency of Transportation to provide technical assistance to municipalities in relation to implementation of complete streets; (10) require the updated Vermont State Standards to incorporate complete streets principles and consideration of green infrastructure; (11) establish right-to-charge laws to permit property owners and tenants to install electric vehicle supply equipment (EVSE); (12) require EVSE that is available for public use to accept credit cards for payment; (13) require the Agency of Transportation to examine the possibility of generating revenue from utilities located in State-owned rights of way, to permit parking in State-owned rights of way in downtowns, and to identify locations for collocating EVSE and on-street parking in State-owned rights of way; (14) amend the traffic-control signals a bicycle operator must follow; (15) provide additional funding and support for projects to improve resiliency of municipal highways; (16) study potential cost savings for education-related transportation; and (17) provide funding for first-time car buyer classes.
