LD1971 An Act to Protect Workers in This State by Clarifying the Relationship of State and Local Law Enforcement Agencies with Federal Immigration Authorities This bill enacts provisions to clarify the relationship of state and local law enforcement agencies, including correctional facilities, and state employees with federal immigration authorities. The bill: 1. Prohibits a law enforcement agency from stopping, investigating, interrogating, arresting or detaining a person for immigration enforcement purposes, including in response to a hold request, immigration detainer or administrative warrant issued by the United States Department of Homeland Security, or allowing the United States Department of Homeland Security access to inmates or inmate information or providing law enforcement agency resources or personnel to assist immigration enforcement activities; 2. Clarifies that a law enforcement agency upon a request from the United States Department of Homeland Security may arrest and detain a person and perform other law enforcement duties due to suspected criminal activity or other reasons not solely based on the person's immigration status; 3. Establishes the permissible scope of collaboration of a law enforcement agency with a joint law enforcement task force; 4. Requires a law enforcement agency to release as soon as possible and detain no longer than 48 hours a person determined to be held solely for immigration enforcement purposes; 5. Establishes duties and prohibitions for law enforcement agencies regarding immigration issues of inmates, including requiring the agency to inform an inmate of the inmate's rights prior to interview by an immigration authority and whether the agency intends to comply with a hold request and prohibiting an agency from restricting access to educational programming and good conduct credits or determining an inmate's custodial status based upon the inmate's immigration status; and 6. Prohibits state employees other than law enforcement officers from inquiring into immigration status unless the inquiry is required by law or necessary to provide the service sought by the resident. LD1626 An Act to Improve Professional Development for Educational Technicians and School Support Staff This bill establishes requirements for annual training and professional development opportunities that a school administrative unit must provide to educational technicians and other school support staff. School administrative units must provide specific training opportunities for educational technicians and other school support staff, including training on emergency procedures and policies, confidentiality, reporting obligations, roles and responsibilities of school employees, discipline policies and school facilities. A school administrative unit must additionally provide training opportunities for educational technicians on disabilities and behavioral needs of the students the educational technicians work with, following lesson plans, the individual needs of each student and paid time or time during the school day to review or be briefed on a student's individualized education program. LD1383 An Act to Require State Divestment from Perpetrators of International Human Rights Violations This bill prohibits the State from investing public funds or entering into procurement contracts with companies, entities, persons or financial institutions that operate in, directly benefit from or are associated with perpetrator states, countries or governing bodies that have been determined by independent and credible international bodies to have committed the crime of apartheid, ethnic cleansing, genocide or a war crime. The bill directs the Office of the Treasurer of State to create a commission to monitor human rights reports to identify potential perpetrator states, countries or governing bodies and to report the activities and findings regarding compliance with the provisions of this bill annually to the Governor and the Legislature. The bill creates exceptions for humanitarian aid and allows for a waiver related to an investment, procurement or divestment by the Governor in cases of significant harm to the residents of this State or that undermine national security interests. LD1587 An Act to Establish Greater Alignment of Penalties for Certain Labor Law Violations This bill codifies into the Maine Revised Statutes provisions of the federal Fair Labor Standards Act of 1938 and creates a criminal penalty for any person who intentionally or knowingly violates the employment practices laws or the laws governing preference to Maine works and contractors. A person convicted of a willful violation is subject to a fine of not more than $10,000 or to imprisonment of not more than 6 months, or both, except that a person may not be imprisoned unless that person has been previously found guilty of willfully violating these laws. The Director of Labor Standards within the Department of Labor may refer these violations to the Attorney General for prosecution. The Attorney General must respond to the director within 30 days of receiving the referral, indicating whether the Attorney General will prosecute the case. If the Attorney General declines to prosecute, the Attorney General must provide to the director the reasons for the denial. This bill also requires that any information related to these willful violations must be included in the department's annual report, including any fines sought or collected by the department, the number of referrals made by the director and the number of referrals declined by the Attorney General, including the reasons for the denials. LD1617 An Act to Lower the Exclusion Amount for the Estate Tax and Create an Exclusion for Family Farms and Aquaculture, Fishing and Wood Harvesting Businesses This bill lowers the exclusion amount, below which the Maine estate tax does not apply, to $1,000,000 from the $5,600,000 in current law for estates of decedents dying on or after January 1, 2026. The bill also creates an additional exclusion amount from the estate tax for family farms and aquaculture, fishing and wood harvesting businesses of up to $3,800,000. This additional exclusion applies to farmland or depreciable machinery and equipment used in commercial agriculture, aquaculture, fishing or wood harvesting that is inherited by a family member and remains in commercial use for 5 years following transfer. LD1499 An Act to Revoke the Tax-exempt Status of an Organization That Fails to Report Sexual Assaults Committed by Employees, Board Members, Volunteers or Affiliates This bill requires an organization that is tax exempt pursuant to the Internal Revenue Code, Section 501(c), including a religious, charitable, educational or nonprofit entity, to report all allegations of sexual assault involving that organization's employees, board members, volunteers or affiliates to law enforcement authorities. "Sexual assault" is defined as any criminal act that constitutes a sexual offense under state or federal law. If a tax-exempt organization fails to report at least 2 separate allegations of sexual assault within a 10-year period, as determined by a court or fact finder in an administrative hearing, that must be reported to the Department of Administrative and Financial Services, Bureau of Revenue Services, which is required to revoke the organization's tax-exempt status for all activities conducted within the State and provide the organization with the opportunity to appeal that revocation. An organization may apply for reinstatement of tax-exempt status after 5 years by demonstrating full compliance with reporting laws, implementation of child protection policies and training programs and cooperation with law enforcement investigations related to prior failures to report. It changes the family income limit for qualified elderly or disabled persons from 100% to 138% of the nonfarm income official poverty line. 2. It changes the family income limit for parents and caretaker relatives from 100% to 138% of the nonfarm income official poverty line. 3. It raises the age of eligibility for a person otherwise eligible who is a noncitizen legally admitted to the United States to the extent that coverage is allowable by federal law from under 21 years of age to under 23 years of age. 4. It raises the maximum asset limits for members subject to an asset test from $8,000 for an individual to $15,000 and from $12,000 for a household of more than one person to $25,000. 5. It directs the Department of Health and Human Services to establish by rule that the maximum asset limits for those who are working with a disabling condition is $15,000 for an individual and $25,000 for a household of more than one person. LD1238 An Act to Establish a Small-cap Loan Guarantee Program for Affordable Housing Investments This bill creates the Small-cap Loan Guarantee Program, through which the State provides loan guarantees to investors and developers for small-cap projects. A small-cap project is an affordable housing or low-income housing construction or rehabilitation project with a value of $1,000,000 or less. Under the bill, affordable housing is housing that is affordable to a household with an income at or below 80% of the area median income, as defined by the United States Department of Housing and Urban Development, and low-income housing is housing specifically designed to serve a household with an income at or below 60% of the area median income, as defined by the United States Department of Housing and Urban Development. The program is administered by the Maine State Housing Authority or an organization contracted by the Maine State Housing Authority to administer the program and funded by application fees based upon the amount and risk assessed of each loan guaranteed by the program. LD1475 Resolve, to Establish the Commission to Study the Taxation of Digital Assets This resolve establishes the Commission on the Taxation of Digital Assets. The commission is composed of 10 members, including Legislators, members with experience in taxation and members representing the business community. The commission must review and evaluate tax policies in other states and recommend possible policy approaches for the taxation of digital assets in this State, including cryptocurrency and nonfungible tokens. The commission must report its findings and recommendations to the Joint Standing Committee on Taxation by December 3, 2025. LD1693 An Act to Establish a Sustainable Housing Development Prison Work Program This bill requires the Department of Corrections to establish and administer a sustainable housing development work program in consultation with the Department of Labor and the Maine State Housing Authority. The program must be designed to train residents of the Department of Corrections in home construction techniques with an emphasis on green and renewable construction methods. It must also establish partnerships with community colleges and trade organizations to offer home construction-related certification programs to participating residents. Lastly, it must facilitate the construction of homes by the residents and other individuals participating in the program. The homes must be constructed to meet or exceed applicable energy efficiency standards under the Maine Uniform Building and Energy Code and have at least 50% of their energy consumption provided by renewable energy sources. The program must give priority to construction materials sourced from within the State, and construction waste must be minimized by using recycling programs. Constructed homes must be owned by the Maine State Housing Authority or other state agency determined appropriate by the Commissioner of Corrections. Participating residents are eligible for a sentence reduction of one day for every 40 hours of work completed under the program. Residents must also maintain a custody classification of minimum or lower during their participation in the program, and all work completed through the program must meet safety and quality standards as determined by the commissioner. Sentence reductions may not exceed 25% of a resident’s total term of imprisonment. The bill establishes a nonlapsing fund within the Department of Corrections for the purposes of supporting the program. The bill also requires the commissioner to establish an oversight committee, which must monitor the implementation of the program and the program’s adherence to the provisions of the bill and any rules the commissioner establishes related to the program. The department is required to submit an annual report regarding the program starting January 1, 2026 to the joint standing committee of the Legislature having jurisdiction over criminal justice and public safety matters. The report must include how many homes have been built under the program, the adherence to renewable standards as required by the program, recidivism rates of residents participating in the program, the amount of sentence reductions applied and the cost of the program. The bill also directs the Department of Administrative and Financial Services, Bureau of Revenue Services to develop a proposal for implementation of a refundable tax credit for persons donating materials or services to the program. By December 3, 2025, the bureau must submit a report setting forth the tax credit proposal, including necessary implementing legislation, along with any recommendations to the Joint Standing Committee on Taxation. LD1262 An Act to Improve Government Transparency and Accountability by Establishing a Process to Allow a Person to Require the State to Enforce Certain Laws and Rules This bill amends the Maine Administrative Procedure Act to authorize a person to petition an agency or the Attorney General, as applicable, to enforce an existing law or rule. It also establishes the Fund for Administrative Oversight within the Office of the Attorney General, to be overseen and administered by a fund administrator, appointed by the Governor. Revenue credited to that fund must be distributed to support: 1. Actions by persons seeking to petition or that have petitioned an agency for adoption or modification of rules; 2. Actions by persons seeking to petition or that have petitioned an agency or the Attorney General to initiate a proceeding to enforce an existing law or rule; and 3. Actions by persons seeking to intervene or otherwise participate in an agency rulemaking conducted, in an adjudicatory proceeding or in a licensing action. In distributing funds to such persons, the fund administrator must give priority to persons that are not commercial entities or entities that are otherwise subject to regulation under law or rule; whose interest or position, as determined by the fund administrator, is not otherwise adequately represented in the rulemaking, proceeding or licensing action; and whose interest or position, as determined by the fund administrator, is primarily focused on protecting or conserving the State's natural resources or environment, protecting the public health or safety or ensuring freedom of access to public information and government transparency. The bill also directs the Office of the Attorney General to consult with each state agency that issues licenses, permits or other approvals to persons to engage in regulated activities relating to the environment, natural resources, public health and safety and freedom of information and government transparency to identify a mechanism for imposing an additional fee amount for the issuance of those licenses, permits or approvals to support activities under the Fund for Administrative Oversight, in a manner designed to satisfy the anticipated annual demand for distributions from that fund for the agency. The fee amounts identified must be reasonable, must not unreasonably impede the activities of the regulated entity and must be designed to reflect the anticipated cost to the agency of oversight of the regulated entity and addressing any potential violations by the regulated entity, including any costs of corrective action or remediation undertaken by the agency. By January 1, 2026, the office must submit a report to the Joint Standing Committee on State and Local Government outlining its recommendations for imposing such additional fee amounts, including necessary proposed legislation, and the committee may report out related legislation. The recommendations and proposed legislation must be designed to provide for assessment and collection of the additional fee amounts beginning July 1, 2026 and must provide that of those fee amounts collected, 1/2 must be retained by the state agency assessing the fee to support its oversight and enforcement activities and 1/2 must be transferred to the Fund for Administrative Oversight to support activities under that fund. LD1053 An Act to Ensure That Rebates from Prescription Drug Manufacturers Are Passed on to Patients at Pharmacies This bill removes a provision that requires that compensation remitted by or on behalf of a pharmaceutical manufacturer, developer or labeler to a pharmacy benefits manager be remitted to the carrier if it is not remitted to the covered person. It retains the provision that requires that the compensation be remitted to the covered person to reduce the out-of- pocket costs associated with a prescription drug. It requires pharmacy benefits managers to annually report compliance with this requirement to the Superintendent of Insurance. It authorizes the superintendent to impose civil penalties and take enforcement action for noncompliance by a carrier or pharmacy benefits manager. LD734 An Act to Promote Voter Registration for Students in Maine's High Schools This bill requires secondary schools to annually organize and facilitate voter education and registration activities beginning in the 2026-2027 school year. A secondary school must designate a school employee or a 3rd party as a voter registration drive coordinator who will be responsible for organizing the activities. The voter registration drive coordinator must coordinate the distribution and collection of voter registration applications from the Secretary of State and deliver or mail completed voter registration applications to the appropriate town clerk or to the Secretary of State within 5 days of the conclusion of the drive and no later than the close of business on the 21st day before election day. The secondary school must notify the Secretary of State of the name and title of the voter registration drive coordinator. The bill also requires that voter education and registration activities be offered during social studies classes, homerooms or assemblies and that a student must be at least 16 years of age to participate in a voter registration drive. Voter registration applications must be offered in both online and paper registration formats, and a voter registration drive must have information about voter eligibility available to students at the time of the drive. Prior to and following a voter registration drive, a secondary school must keep voter registration applications and information about voter eligibility in a location easily accessible to students.
