Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and Whereas, there are currently intoxicating hemp products for sale in this State for which there is no legal restriction preventing sale to minor children; and Whereas, some of those products may be designed or packaged in a manner that a person, including a child, could potentially be led to confuse the intoxicating products for nonintoxicating products typically marketed to children, such as gummies or similar products; and Whereas, ingestion of intoxicating hemp products by a child can cause harm to the child; and Whereas, it is in the interest of child safety for the restrictions directed by this legislation to go into effect as soon as possible; and Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore, Signed/Enacted/Adopted

LD1699 An Act to Create a Refundable Tax Credit for Agricultural Enterprises This bill allows an agricultural enterprise to qualify for the Maine Seed Capital Tax Credit Program, which provides an eligible business a tax credit for investments in plant, equipment, research and development, or working capital for the business or such other business activity as may be approved by the Finance Authority of Maine. The bill allows an agricultural enterprise determined eligible by the authority to qualify for a tax credit for investments made in infrastructure, not including real estate, but including any improvement that expands the marketing, production or processing of agricultural products, in addition to the qualifying investments that may be made by a business. LD1739 An Act to Authorize a General Fund Bond Issue to Support Maine's Agricultural Sector, to Create an Agricultural Buildings Property Tax Exemption and to Direct the Department of Agriculture, Conservation and Forestry to Study Barriers to Its Financial Assistance Programs and Study the Potential for a Common Application for Those Programs This bill does the following. 1. The funds provided by the bond issue in Part A, in the amount of $55,600,000, will be used to support the agricultural sector in the State. 2. Part B establishes a property tax exemption for certain agricultural and horticultural structures and buildings. 3. Part C requires the Commissioner of Agriculture, Conservation and Forestry to direct staff of the Department of Agriculture, Conservation and Forestry, Bureau of Agriculture, Food and Rural Resources to study the bureau's financial assistance programs for farmers and food producers to identify barriers to accessing these programs and methods to eliminate those barriers and increase the effectiveness of the programs in addressing farmer and food producer needs. The study must also include an examination of how to create a simple common application for all of the department's financial assistance programs. The commissioner is required to submit a report by January 15, 2027 to the joint standing committee of the Legislature having jurisdiction over agriculture, conservation and forestry matters, which may report out legislation to the 133rd Legislature in 2027. LD749 An Act to Ensure That the Will of the Voters Is Reflected in Interim Appointments of United States Senators This bill provides that if there is a vacancy in the office of United States Senator and the person who vacated the office was enrolled in a political party at the time of that person's last election to that office, the qualified person appointed to fill the vacancy must have been enrolled in that party at the time of the most recent election and at the time the office was vacated and must be enrolled in that party at the time the qualified person is appointed. If the person who vacated the office was not enrolled in a political party at the time of that person's last election to that office, the qualified person appointed to fill the vacancy may not have been enrolled in a political party at the time of the most recent election and at the time the office was vacated and may not be enrolled in a political party at the time the qualified person is appointed. LD1043 An Act to Provide Free Admission to State Parks and Historic Sites for the Immediate Family Members of Veterans and Active Military Personnel This bill directs the Commissioner of Agriculture, Conservation and Forestry to issue free day use passes to state parks and historic sites to immediate family members of qualifying veterans and active duty military members as determined by the Department of Defense, Veterans and Emergency Management. The language of the bill allows immediate family members to hold their own passes, rather than only permitting family members to use the qualifying veteran's or active duty military member's pass. The bill defines "immediate family members" as the spouse, domestic partner and dependent children of a veteran or active duty military member. Passed

LD1252 An Act to Amend the Laws Governing the Maine Agriculture, Food System and Forest Products Infrastructure Investment Advisory Board This bill modifies provisions of the law governing the Maine Agriculture, Food System and Forest Products Infrastructure Investment Advisory Board and disbursements from the Maine Agriculture, Food and Forest Products Investment Fund, which the advisory board oversees. The bill requires that disbursements may be made only to a producer of agricultural, food or forest products that has or is seeking to establish a processing or manufacturing facility located in the State. A producer receiving a disbursement must use the disbursement to support the operations of a processing or manufacturing facility located in this State for the following purposes, including, but not limited to, obtaining equipment and investing in supply chain infrastructure to grow, harvest, process or manufacture agricultural, food or forest products used in commercial products. In carrying out these purposes, the producer must obtain, to the extent practicable, agricultural, food or forest products from a farm or a forest or waters in the State or from offshore waters to be collected in the State. The bill also prohibits a member of the advisory board from participating in any vote when that member has a conflict of interest. A conflict of interest exists when the board member or a member of the board member's immediate family has or would acquire a direct and substantial personal financial interest, distinct from that of the general public, in an enterprise that would be financially benefited by a proposed fund allocation. LD1518 An Act to Clarify the Amount and Use of Unallocated Balances in a School Administrative Unit Budget This bill amends the laws governing unexpended balances and unallocated general operating fund balances of school administrative units in the following ways. 1. It changes the current requirement that the unexpended balance of all money raised by a school administrative unit received for school purposes be carried forward and credited to the unit for educational programs in the ensuing year, to instead require that the unexpended balance be carried forward and spent by the unit in the ensuing year. 2. It changes the current requirement that unallocated general operating fund balances in excess of 5% of the previous fiscal year's school budget be used to reduce the state and local share of the total allocation for the purpose of computing state subsidy, to instead require that the unallocated balances in excess of 5% be used to fund educational programs. It authorizes school boards to carry forward unallocated balances in excess of 5% of the previous year's school budget and spend those funds for educational programs in the next year or over a period not to exceed 3 years. 3. It strikes language that applies only to fiscal years 2021-22, 2022-23, 2023-24 and 2024-25. Dead
