HCR1001 Voter Approval for State Vendor Fee Reductions The concurrent resolution refers to the voters of the state at the general election a constitutional amendment to require voter approval in advance for any change to state law that would reduce the vendor fee allowed to retailers that collect state sales tax. WHEREAS, The clauses appearing before Section 1 of this measure express the intent of the general assembly in adopting the measure and are intended to be included as part of the text of the measure for purposes of publication pursuant to section 1-40-124, Colorado Revised Statutes, and the ballot information booklet pursuant to section 1 (7.5) of article V of the state constitution and section 1-40-124.5, Colorado Revised Statutes; and WHEREAS, Colorado's small retailers are essential to the health of our economy and the strength of our communities, and these businesses serve as employers, community partners, and local anchors, while also collecting and remitting sales taxes on behalf of the state-a responsibility that comes with both time and cost; and WHEREAS, The vendor fee was established to recognize this work and to help offset the administrative burden placed on retailers, and it has long been a stable and predictable form of relief for small businesses facing the pressures of regulation, inflation, and changing market conditions; and WHEREAS, Reductions to the vendor fee, without the consent of the people, would impose an additional cost on small retailers, effectively increasing the amount of state revenue collected from them without voter approval, and the Colorado constitution, through the Taxpayer's Bill of Rights, ensures that Coloradans have the final say on new or increased HCR25B-1001 taxes; and WHEREAS, It is the intent of the general assembly to protect small retailers and preserve the spirit of taxpayer consent by requiring that any reduction in the vendor fee be approved by Colorado voters, and this safeguard will ensure that changes affecting thousands of small businesses across the state are made only with the approval of the people they serve; now, therefore, Dead
SB007 Immigration Status Low-Income Health Insurance Coverage Current law extends health insurance coverage to various people, including low-income pregnant and postpartum people and children in low-income families, whose immigration status would otherwise make them ineligible for coverage under state-federal programs or would limit the coverage's scope or duration. Other expansions make state-subsidized individual health insurance coverage available for certain people, regardless of immigration status. The bill modifies several provisions related to these coverage expansions by: ! Prohibiting the department of health care policy and financing (HCPF) from reimbursing a health-care provider, entity, or facility for providing medical services to a person who is not a lawful resident; ! Eliminating full health insurance coverage for pregnant and postpartum people who would be eligible for medicaid or the children's basic health plan if not for their immigration status; ! Eliminating full health insurance coverage for children who would be eligible for medicaid or the children's basic health plan if not for their immigration status; ! Repealing the state reproductive health-care program, the medical assistance program, and the state children's basic health plan (state-funded programs) that were established to provide expanded coverage; ! HB1012 Income Tax Expenditures for Service Members Legislative Oversight Committee Concerning Tax Policy. The bill changes how income tax expenditures that benefit individuals engaged in military service are provided as follows: ! Beginning with income tax years commencing on or after January 1, 2027, section 2 of the bill eliminates the state income tax subtraction for an amount equal to any compensation received for active duty service in the armed forces of the United States by an individual who has reacquired residency in the state to the extent that the compensation is included in federal taxable income; and ! For income tax years commencing on or after January 1, 2027, but before January 1, 2032, section 3 allows a refundable income tax credit (credit) as a form of tuition assistance to an actively serving member of the Colorado National Guard who is eligible for tuition assistance (eligible member) under an existing statutorily-authorized program (program) administered by the department of veterans and military affairs (department). To claim the credit, an eligible member must obtain a tax credit certificate issued by the department for each academic semester or quarter for which tuition assistance is awarded in the form of the credit. The criteria for receiving a tax credit certificate are generally the same as the criteria for receiving other tuition assistance under the program; except that, to be eligible for a tax credit certificate, an eligible member must apply for all federal government tuition assistance that is not required to be repaid and that is generally made available to eligible members and not to the general population and must use all federal government tuition assistance received. The total amount of tuition assistance that an eligible member to whom the department has issued a tax credit certificate may obtain under the program, including the credit, is subject to existing program limits. In addition, the department may issue no more than $1 million in tax credit certificates for any income tax year. Section 1 makes conforming amendments. Dead
SB120 Nuclear Workforce Development & Education Program The bill creates the Colorado nuclear workforce development and education program (program) in the department of higher education (department) to help meet growing workforce demand in the nuclear energy sector. The bill establishes a related grant program to provide grants to institutions of higher education for the development or expansion of nuclear engineering degree or certificate programs or course offerings. The Colorado nuclear workforce development and education council shall advise and assist the department regarding the grant program's implementation and evaluation. The department may seek, accept, and expend gifts, grants, and donations for program-related purposes. The state treasurer shall credit the gifts, grants, and donations to the Colorado workforce development and education cash fund (cash fund). The general assembly shall not appropriate general fund dollars to implement or maintain program operations or grant awards. The department shall begin awarding grants only after the balance of the cash fund reaches or exceeds $500,000. The bill imposes requirements to report to the general assembly about the program's implementation and use of funds. The bill repeals the program, effective September 1, 2032, unless the program is extended pursuant to a sunset review. Dead

SB013 Senior Housing Income Tax Credit Extension Legislative Oversight Committee Concerning Tax Policy. Section 2 of the bill extends a refundable income tax credit (credit) that is available for the income tax years commencing on January 1, 2022, and January 1, 2024, so that the credit is also available for the income tax years commencing on January 1, 2025, and January 1, 2026. For each income tax year, the credit is for a qualifying senior, which means a resident individual who: ! Is 65 years of age or older at the end of the income tax year; ! Has federal adjusted gross income (AGI) that is less than or equal to $75,000 if filing a single return, or less than or equal to $125,000 if filing a joint return; and ! Has not claimed the senior property tax exemption for the property tax year that coincides with the income tax year. The amount of the credit for both the 2025 and 2026 income tax years is: ! $800 for a qualifying senior filing a single return with federal AGI that is $25,000 or less. For every $500 of federal AGI above $25,000, the amount of the credit is reduced by $8. ! $800 for 2 taxpayers filing a joint return with federal AGI that is $25,000 or less. For every $500 of federal AGI above $25,000, the amount of the credit is reduced by $4. ! $400 for each taxpayer, in the case of 2 taxpayers who share the same primary residence, and may legally file a joint return but actually file separate returns and both claim the credit. For every $500 of federal AGI above $25,000, the amount of the credit is reduced by $4. Notwithstanding the income-based reductions in the allowable credit amount, a taxpayer who also qualifies for a property tax and rent assistance grant or heat assistance grant during the calendar year 2025 or is eligible to receive the full amount of the credit. Section 1 requires the property tax administrator to provide reports from counties related to taxpayers who are eligible for and actually claim the homestead property tax exemption. Dead

SB131 Reducing the Cost of Housing Current law restricts construction defect negligence claims unless the negligence claim arises from a construction defect which results in actual damage to or loss of the use of real or personal property; bodily injury or wrongful death; or a risk of bodily injury or death to, or a threat to the life, health, or safety of, the occupants of the residential real property. Section 1 of the bill changes this restriction so that all construction defect claims are restricted unless the claim arises from a construction defect that causes: ! Actual damage to real or personal property caused by the violation of a building code, manufacturer's instructions, or industry standard; ! Actual loss of the use of real or personal property; ! Bodily injury or wrongful death; or ! An imminent and unreasonable risk of bodily injury or death to, or an imminent or unreasonable threat to the life, health, or safety of, the occupants of the residential real property. Sections 2 through 12 modify existing warranty of habitability laws by repealing recent updates and reenacting the laws as they were prior to the updates. The modifications include repealing certain procedures for both landlords and tenants when a warranty of habitability claim is alleged by the tenant; repealing a rebuttable presumption that a landlord failed to remedy an uninhabitable premises in certain conditions; modifying requirements regarding notice given to a landlord of an uninhabitable premises; and modifying other laws related to rental agreements, records, and procedures for remedying uninhabitable premises. Section 13 repeals law that allows the attorney general to independently initiate and bring actions to enforce laws relating to the warranty of habitability. Section 14 makes a conforming change to law governing county courts' jurisdiction over cases involving tenant's remedies in warranty of habitability cases and tenant's remedies in cases of unlawful removal. Section 15 modifies the statement included in a summons issued to a defendant in a court proceeding regarding an action for possession brought by a landlord. Sections 16 through 20 repeal provisions related to evictions of residential tenants, including repealing: ! Requirements that a landlord and residential tenant participate in mandatory mediation prior to commencing an eviction action if the residential tenant receives cash assistance; ! A prohibition on a law enforcement officer's ability to execute a writ of restitution until 30 days after the entry of judgment if the residential tenant receives cash assistance; ! Requirements that a written demand include a statement that a residential tenant who receives cash assistance has a right to mediation prior to the landlord filing an eviction complaint; ! Requirements that a written rental agreement include a statement that current law prohibits source of income discrimination and requires a nonexempt landlord to accept any lawful and verifiable source of money paid directly, indirectly, or on behalf of a person; and ! Requirements that prohibit a written rental agreement from including a waiver of mandatory mediation or a clause that allows a landlord to recoup any costs associated with mandatory mediation. Sections 21 and 22 require any provision of any energy code adopted by a county or municipality on or after January 1, 2026, to be cost effective. "Cost effective" means, using the existing energy efficiency standards and requirements as a base of comparison, that the economic benefits of the proposed energy efficiency standards and requirements will exceed the economic costs of those standards and requirements based upon an incremental multi-year analysis. SB073 Military-Connected Children with Disabilities The bill clarifies the process and timeline for an administrative unit or a state-operated program to provide special education services to a military-connected child with disabilities (child) who transfers from one administrative unit or state-operated program within Colorado to another, or transfers from an out-of-state school district or private school to an administrative unit or a state-operated program within Colorado, as a result of an inbound active duty military member's (member) order to permanently change military stations. For a child who transfers from an administrative unit or state-approved program to a private school within Colorado, or transfers from an out-of-state school district or private school to a private school within Colorado, the administrative unit with jurisdiction over the geographic boundary that the private school is located in shall review the child's evaluation information and existing individualized education program (IEP) or section 504 plan in consultation with the child's member, parent, legal guardian, or custodian. The administrative unit shall determine and provide equitable special education and related services, an IEP, or a section 504 plan to the child enrolled in the private school. For a child who transfers from an out-of-state school district or private school with an individualized family service plan, the administrative unit or the state-operated program shall follow the process to coordinate, in conjunction with the department of early childhood, the transition of the child from an early intervention program for infants and toddlers pursuant to part C of the federal "Individuals with Disabilities Education Act" (IDEA) to a program component to serve children with disabilities from 3 to 21 years of age pursuant to part B of the IDEA. The bill requires an administrative unit, a state-operated program, or an administrative unit with jurisdiction over the geographic boundary that a private school is located in to receive informed consent from the member, parent, legal guardian, or custodian of a child before: ! There are revisions to the child's category of disability; ! There are revisions to the child's IEP or section 504 plan; ! There are changes to the child's eligibility for special education and related services; or ! There is a partial or complete termination of special education and related services, except if the child graduates with a standard or advanced studies diploma. Section 6 repeals the 10-cent paper carryout bag fee created in House Bill 21-1162, enacted in 2021. Section 7 repeals the confinement standards for egg-laying hens whose eggs are sold in Colorado, which standards were created in House Bill 20-1343, enacted in 2020. Section 8 repeals the authorization for counties and municipalities to collect special sales taxes on nicotine products, which authorization was created in House Bill 19-1033, enacted in 2019. Section 9 repeals the energy assistance system benefit charge created in House Bill 21-1105, enacted in 2021. SB156 Reducing Costs of State Regulation Sections 1 and 2 of the bill prohibit a state agency from imposing a personal qualification requirement in order to engage in a profession or occupation unless the agency can show that the requirement is demonstrably necessary and narrowly tailored to address a specific, legitimate public health, safety, or welfare objective. On or before July 1, 2026, every agency must review occupational regulations and determine whether the regulation should be repealed or amended. Any person may file a petition with an agency requesting that an occupational regulation be repealed or amended. Regardless of whether a petition is filed with an agency, any person may file a civil suit requesting that the court enjoin the adoption or enforcement of an occupational regulation. When an agency files a notice of proposed rule-making with the secretary of state, if the proposed rule-making includes a proposed occupational regulation, the agency must also submit a statement to the secretary of state describing how the proposed occupational regulation complies with the bill's requirements. Section 3 repeals the industrial and manufacturing operations clean air grant program, the cannabis resource optimization cash fund, the community access to electric bicycles grant program, and the electrifying school buses grant program, which were enacted in 2022 by Senate Bill 22-193. Section 4 repeals the energy code board and its associated model codes, an energy code training grant program, the building electrification for public buildings grant program, the high-efficiency electric heating and appliances grant program, and the clean air building investments fund, which were enacted in 2022 by House Bill 22-1362. Section 5 repeals the air quality enterprise, which was enacted in by Senate Bill 20-204. Section 6 repeals the environmental response surcharge, the perfluoroalkyl and polyfluoroalkyl substances cash fund, the perfluoroalkyl and polyfluoroalkyl substances grant program, the perfluoroalkyl and polyfluoroalkyl substances take-back program, and certain civil penalties for violations of certain air quality control regulations, which were enacted in 2020 by Senate Bill 20-218. Section 7 repeals certain requirements, including requirements regarding fenceline monitoring and community-based monitoring of air toxics, for covered facilities, which requirements were enacted in 2021 by House Bill 21-1189. HB1265 Modification of County Commissioner Elections Currently, in a county with a population of 70,000 or more, the board of county commissioners (board) may consist of 3 commissioners from 3 districts, with one commissioner elected from each district by voters of the whole county. Alternatively, the board may consist of 5 commissioners, in which case the county may be divided into 3 or 5 districts, and the commissioners may be elected pursuant to numerous methods, including by district or at large or by some combination of both methods. The bill modifies this discretionary system for any county with a population of 250,000 or more by requiring each such county to have 5 commissioners and 5 districts and to choose one of the following 3 methods for their election: ! commissioners resident in 5 districts elected only by voters resident in those districts; ! commissioners resident in 3 districts elected only by voters resident in those districts and 2 commissioners elected at large; or ! commissioners elected at large using the proportional ranked voting method known as the single transferable vote method. The fee imposed by the state on short-term motor vehicle rentals; ! The passenger per-ride fees imposed on car share rides by the state, the clean fleet enterprise, and the nonattainment area air pollution mitigation enterprise; and ! The waste tire enterprise fee imposed on the purchase of new motor vehicle and trailer tires by the waste tire management enterprise. Because this fee is the only source of revenue for the waste tire management enterprise, the bill also repeal the enterprise. The bill also requires the nonattainment area air pollution mitigation enterprise, no later than January 1, 2026, to establish a reformulated gasoline cost stabilization program to offer reformulated gasoline cost stabilization rebates to individuals who own motor vehicles that are registered in counties in which the federal government requires all gasoline sold to be reformulated gasoline.
