LD1699 An Act to Create a Refundable Tax Credit for Agricultural Enterprises This bill allows an agricultural enterprise to qualify for the Maine Seed Capital Tax Credit Program, which provides an eligible business a tax credit for investments in plant, equipment, research and development, or working capital for the business or such other business activity as may be approved by the Finance Authority of Maine. The bill allows an agricultural enterprise determined eligible by the authority to qualify for a tax credit for investments made in infrastructure, not including real estate, but including any improvement that expands the marketing, production or processing of agricultural products, in addition to the qualifying investments that may be made by a business. LD1252 An Act to Amend the Laws Governing the Maine Agriculture, Food System and Forest Products Infrastructure Investment Advisory Board This bill modifies provisions of the law governing the Maine Agriculture, Food System and Forest Products Infrastructure Investment Advisory Board and disbursements from the Maine Agriculture, Food and Forest Products Investment Fund, which the advisory board oversees. The bill requires that disbursements may be made only to a producer of agricultural, food or forest products that has or is seeking to establish a processing or manufacturing facility located in the State. A producer receiving a disbursement must use the disbursement to support the operations of a processing or manufacturing facility located in this State for the following purposes, including, but not limited to, obtaining equipment and investing in supply chain infrastructure to grow, harvest, process or manufacture agricultural, food or forest products used in commercial products. In carrying out these purposes, the producer must obtain, to the extent practicable, agricultural, food or forest products from a farm or a forest or waters in the State or from offshore waters to be collected in the State. The bill also prohibits a member of the advisory board from participating in any vote when that member has a conflict of interest. A conflict of interest exists when the board member or a member of the board member's immediate family has or would acquire a direct and substantial personal financial interest, distinct from that of the general public, in an enterprise that would be financially benefited by a proposed fund allocation. LD1739 An Act to Authorize a General Fund Bond Issue to Support Maine's Agricultural Sector, to Create an Agricultural Buildings Property Tax Exemption and to Direct the Department of Agriculture, Conservation and Forestry to Study Barriers to Its Financial Assistance Programs and Study the Potential for a Common Application for Those Programs This bill does the following. 1. The funds provided by the bond issue in Part A, in the amount of $55,600,000, will be used to support the agricultural sector in the State. 2. Part B establishes a property tax exemption for certain agricultural and horticultural structures and buildings. 3. Part C requires the Commissioner of Agriculture, Conservation and Forestry to direct staff of the Department of Agriculture, Conservation and Forestry, Bureau of Agriculture, Food and Rural Resources to study the bureau's financial assistance programs for farmers and food producers to identify barriers to accessing these programs and methods to eliminate those barriers and increase the effectiveness of the programs in addressing farmer and food producer needs. The study must also include an examination of how to create a simple common application for all of the department's financial assistance programs. The commissioner is required to submit a report by January 15, 2027 to the joint standing committee of the Legislature having jurisdiction over agriculture, conservation and forestry matters, which may report out legislation to the 133rd Legislature in 2027. LD161 Resolve, Directing the Department of Agriculture, Conservation and Forestry to Convene a Stakeholder Group Tasked with a Comprehensive Overhaul and Modernization of the State Subdivision Laws This resolve requires the Department of Agriculture, Conservation and Forestry to convene a stakeholder group to review and make recommendations concerning a comprehensive overhaul and modernization of the subdivision laws in the Maine Revised Statutes, Title 12, chapter 206-A; Title 30-A, chapter 187, subchapter 4; and Title 38, chapter 3, subchapter 1, article 6. The resolve lists the minimum membership requirements for the stakeholder group. The department is required to submit a report to the joint standing committees of the Legislature having jurisdiction over subdivision review matters under those laws by December 3, 2025 and those committees may report out legislation related to that report to the Second Regular Session of the 132nd Legislature. LD311 An Act to Improve Efficiency of Meat and Poultry Processing Facilities by Requiring the Designation of State Inspectors as Essential This bill requires the Commissioner of Agriculture, Conservation and Forestry to designate state inspectors authorized to perform inspection functions under the laws governing meat and poultry inspections essential to the operations of establishments at which inspection of the slaughter of livestock or poultry or the preparation of livestock products or poultry products occurs. The bill also directs the commissioner to require, rather than authorize as in current law, inspection to continue at such an establishment on state holidays or beyond the regular work shift or workweek for state inspectors as long as the necessary inspectors are available and the establishment pays all overtime salaries for inspections necessary to keep the plant open and other expenses caused by the overtime employment. LD852 An Act to Reduce the Property Tax Burden by Adequately Funding County Jail Operations This bill amends the laws governing the operation of county jails as follows. 1. It amends the County Jail Operations Fund to provide that, beginning July 1, 2025 and prior to July 1, 2026, state funding must be appropriated annually for the fund in the amount of $25,445,838 plus any additional amount the Legislature may appropriate. Beginning July 1, 2026, state funding must be appropriated annually for that fund in an amount equal to 20% of the total General Fund appropriation to the Department of Corrections for the costs of all correctional facilities under the department plus any additional amount the Legislature may appropriate. Under current law, state funding is required to be appropriated annually for that fund in the amount of $20,342,104. 2. It provides that, in addition to those state funding requirements for the County Jail Operations Fund, beginning July 1, 2026, state funding must be appropriated annually for the fund in an amount equal to 90% of the costs incurred by county jails and the regional jails in the prior fiscal year in complying with the mandatory standards established by the Commissioner of Corrections. 3. It stipulates that, if a county jail fails to report certain information to the department by the end of a fiscal year as required by law, the department shall distribute the quarterly funding payment for that jail under the County Jail Operations Fund between all other jails that are in compliance with the reporting requirement for that quarter. 4. It provides that, in adopting rules and standards for the county jails, the commissioner incorporate the advisory input of the County Corrections Professional Standards Council. Current law only requires the commissioner to consider that advisory input. 5. It amends the law establishing the council to provide that administrative services costs associated with the activities of the council must be paid by the department. Passed

LD1201 An Act to Protect Maine Agriculture and Farms by Exempting Certain Pesticides from Regulation This bill amends the law providing for exemption of certain veterinary products from the law governing products containing perfluoroalkyl and polyfluoroalkyl substances, or PFAS, to allow products approved for use for aerial or land application that are regulated by the United States Environmental Protection Agency pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act. It creates an exemption for a pesticide registered by the United States Environmental Protection Agency pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act applied by a person licensed by the Department of Agriculture, Conservation, and Forestry, Board of Pesticides Control as an agricultural basic applicator, a private applicator or a commercial applicator. LD1528 An Act to Support Farmland Conservation This bill establishes a separate nonlapsing, interest-bearing account administered by the Department of Agriculture, Conservation and Forestry to support public-private partnerships to carry out the purposes of the Maine Working Farmland Access and Protection Program. The account consists of money appropriated or allocated to the program account by the Legislature or received from any private or public source. The bill establishes and provides ongoing funding for one full-time, permanent position within the Department of Agriculture, Conservation and Forestry, Bureau of Agriculture, Food and Rural Resources. LD1709 An Act Regarding Antique Automobiles This bill reduces the age that an automobile or truck must be to be considered an antique auto in the motor vehicle laws from 35 years old to 25 years old. This age requirement was increased from 25 years old to 35 years old in Public Law 2023, chapter 634. The bill requires a person registering an antique auto to show proof of registration and insurance for the motor vehicle used as that person's primary mode of transportation of passengers or goods and maintain the registration and insurance for that motor vehicle or a replacement motor vehicle during the term of registration of the antique auto. A person may not operate an antique auto when a motor vehicle used as that person's primary mode of transportation of passengers or goods is not registered and insured. A person who violates this provision commits a civil violation for which a fine of not more than $2,500 may be adjudged and for which the Secretary of State may immediately revoke the registration for the antique auto.
