This bill extends the amount of time a cultivation facility licensee has to remit the excise taxes to 120 days after a sale upon which an excise tax is levied or, for a cultivation facility that holds a license to operate another cannabis establishment, 120 days after the date of transfer or other licensed activity as specified in the bill. LD1942 An Act to Modify Taxes Applying to Adult Use Cannabis, Hemp and Hemp Products Beginning January 1, 2026, this bill imposes a sales tax of 20% on hemp and hemp products that contain tetrahydrocannabinol, or THC. It changes the percentage from 12% to 6% of the adult use cannabis sales tax and excise tax that is transferred to the Adult Use Cannabis Public Health and Safety and Municipal Opt-in Fund. It changes the method of taxation of adult use cannabis products to 10% of the average wholesale price of adult use cannabis sold by a cultivation facility licensee to other licensees. It provides that an excise tax is not imposed on the sale or transfer of adult use cannabis between cultivation facilities and products manufacturing facilities. It changes payment of the adult use cannabis excise tax to a quarterly schedule. In Committee
LD1211 An Act Regarding Certain Definitions in the Sales and Use Tax Laws Affecting Rental Equipment This bill changes the definition of "automobile" in the sales and use tax laws to provide that a pickup truck or van with a gross vehicle weight rating of 10,000 pounds or less is included only if it is not used primarily to transport goods or freight. The bill also changes the definition of "lease or rental" to provide that it does not include a lease or rental of tangible personal property that is used only at the primary business location of the lessor. LD1908 An Act to Require the Cooperation of Original Manufacturers of Electronic Devices to Facilitate the Repair of Those Devices by Device Owners and Independent Repair Providers This bill requires that, beginning January 1, 2026, an original equipment manufacturer of digital electronic equipment sold or in use in the State on or after July 1, 2021 is required to make available on fair and reasonable terms to any independent repair provider or owner of the digital electronic equipment any documentation, parts or tools required for the diagnosis, maintenance or repair of the equipment. Under the bill, an independent repair provider is a business engaged in diagnosing, maintaining and repairing digital electronic equipment but is not the original equipment manufacturer or a business licensed by the original equipment manufacturer. The bill also prohibits original equipment manufacturers, beginning January 1, 2026, from using software to identify component parts through a unique identifier, also called "parts pairing," to prevent or inhibit an owner or independent repair facility from installing or enabling functional replacement parts or components; intentionally reduce the functionality of the electronic equipment; or cause the electronic equipment to display misleading alerts about unidentified parts that the user cannot immediately dismiss. This provision applies to consumer electronic equipment that is manufactured for the first time, and first sold or used in this State, after January 1, 2026. The bill includes several exceptions that limit an original equipment manufacturer's obligations under the bill. The bill provides that an original equipment manufacturer is not liable for damages resulting from improper use of personal data or a data security breach in connection with repair, diagnosis, maintenance or modification of digital electronic equipment by an independent repair provider or owner. The bill requires that independent repair providers must provide a customer with a written notice explaining that the independent repair provider is not an authorized repair provider for the digital electronic equipment and disclose whether the independent repair provider uses any used parts in performing repair work. LD1734 An Act to Exempt Over-the-counter Medicines from the Sales and Use Tax This bill adds over-the-counter medicines and drugs to the sales tax exemption for medicines sold for humans on a doctor's prescription as long as the over-the-counter medicine or drug is labelled according to the requirements of the United States Food and Drug Administration. Medicines or drugs included in the new exemption include anesthetics; antacids; contraceptive supplies, drugs, devices and products approved by the United States Food and Drug Administration to prevent pregnancy; medication prepared for use in the eyes, ears or nose; opioid antagonists; products intended to be taken for coughs, colds, asthma or allergies; and steroidal medicines. LD1735 An Act to Provide an Income Tax Deduction for Certain Contributions to a Qualified Achieving a Better Life Experience Program Account This bill aligns the tax deductibility of contributions to a qualified ABLE program account with those made to a qualified tuition program established under Section 529 of the United States Internal Revenue Code by allowing up to $1,000 in contributions to be deductible from individual income tax. LD1665 An Act to Provide Property Tax Relief to Maine Families This bill amends the property tax fairness credit, for tax years beginning in 2025 or later by increasing the benefit base as follows: 1. For individuals filing as a head of household who have one child or dependent or for married individuals filing joint returns who have one child or dependent, the benefit base is increased to $3,250; 2. For individuals filing as a head of household who have more than one child or dependent or for married persons who have more than one child or dependent, the benefit base is increased to $4,000; and 3. For individuals 65 years of age or older, the benefit base is increased to $4,250. This bill also increases the maximum credit for an individual filing as a head of household or filing a joint return and who has a child or dependent to $2,000. This bill also requires the Department of Administrative and Financial Services, Bureau of Revenue Services to convene a working group to study the property tax fairness credit and make recommendations for how to make the credit easier to understand and simplify the process for applying for the credit. The working group consists of advocates for low-income and elderly individuals and municipal governments. Passed
LD700 An Act to Promote Student Enrollment and Degree Completion in the University of Maine System by Awarding Waivers of Tuition and Fees to Eligible Students This bill requires the University of Maine System to award waivers of tuition and fees to eligible students who are enrolled full-time at any University of Maine System campus. The amount of the waiver is limited to the difference between the amount of the tuition and fees and the sum of the amount provided by the Federal Pell Grant and the amount of aid received by the student, not including merit-based scholarships awarded to the student by the University of Maine System. LD195 An Act to Create the Small Business Capital Savings Account Program This bill establishes the Small Business Capital Savings Account Program in the Department of Economic and Community Development to certify small businesses engaged in commercial agricultural production, commercial fishing or commercial wood harvesting eligible to claim a tax deduction for contributions made to qualifying small business capital savings accounts to be used for capital expenditures. The bill creates the tax deduction and establishes that withdrawals from the savings accounts are taxable income if not used for capital expenditures. LD1365 An Act to Allow Consumption of Adult Use Cannabis in Locally Approved Hospitality Lounges This bill amends the Cannabis Legalization Act to authorize a municipality or other local government entity within the unorganized and deorganized areas of the State to adopt an ordinance providing licensing or other approval requirements applicable to cannabis hospitality lounges within the municipality or unorganized and deorganized area. The bill defines "cannabis hospitality lounge" as a location that is open to members of the public who are 21 years of age or older and is licensed or approved by a municipality or other local government entity within the unorganized and deorganized areas of the State where persons 21 years of age or older may consume adult use cannabis, adult use cannabis products and edible products that do not contain cannabis. A cannabis hospitality lounge is not a cannabis establishment, may operate as a cannabis hospitality lounge without the need for additional state licensing or approvals and is not subject to the oversight of the Department of Administrative and Financial Services, Office of Cannabis Policy. The bill also amends the law prohibiting smoking in public places to allow the smoking of adult use cannabis or adult use cannabis products at a locally licensed or approved cannabis hospitality lounge. LD332 An Act to Establish Mandatory Minimum Sentences for Gross Sexual Assaults Against Children and Aggravated Sex Trafficking of Children This bill provides that if the State pleads and proves that a gross sexual assault was committed against an individual who had not yet attained 12 years of age, the court is required to impose a definite term of imprisonment of not less than 25 years, none of which may be suspended. It also provides that, in the case of a gross sexual assault committed against an individual who had not yet attained 12 years of age when the defendant had previously been convicted and sentenced for committing gross sexual assault, formerly denominated as gross sexual misconduct, or rape against an individual who had not yet attained 12 years of age or that the defendant had previously been convicted and sentenced for engaging in substantially similar conduct in another jurisdiction against an individual who had not yet attained 12 years of age, the court is required to instead impose a term of imprisonment for life. It also provides that, in the case of aggravated sex trafficking for which the State pleads and proves that the defendant knowingly promoted prostitution of a person who had not yet attained 12 years of age, the court is required to set a definite term of imprisonment of not less than 25 years, none of which may be suspended. The bill also requires the Department of Labor to amend its rules adopted for the program to establish an expedited process for approval of an employer's substitute private plan that is substantially equivalent to the program and to waive the payroll premiums during consideration of an employer's application for exemption. LD359 An Act to Prohibit Net Energy Billing by Certain Customers This bill amends the net energy billing programs established under the Maine Revised Statutes, Title 35-A, sections 3209-A and 3209-B to prohibit customers from having a shared financial interest in distributed generation resources used for the programs. The bill limits the applicability of the net energy billing programs to distributed generation resources that are located on the same side of the meter as the net energy billing customer and are used primarily to serve the electric load of that customer. To participate in the programs, all of the net energy billing credits associated with the output of the distributed generation resource must be allocated to the retail account of that customer. The bill also amends other statutes to reflect the changes made to the net energy billing programs by this bill. Dead
LD1317 An Act to Promote Responsible, Cost-effective Energy in Maine by Amending the Tariff Rates Applicable to the Commercial and Institutional Net Energy Billing Program This bill amends the commercial and institutional net energy billing program, starting in 2026, to allow the Public Utilities Commission to establish by rule the tariff rate applicable to all customers in the program, regardless of the size of the distributed generation resource involved in net energy billing. The bill requires the commission to establish the 2026 tariff rate at a rate between 12¢ per kilowatt-hour and the lesser of the tariff rates applicable in 2025. It requires the commission to establish the 2027 tariff rate at a rate between 12¢ per kilowatt-hour and the tariff rate applicable in 2026. LD1559 An Act to Authorize Medical Cannabis Farmers' Markets This bill amends the Maine Medical Use of Cannabis Act to provide for the licensure of medical cannabis farmers' markets. The bill defines "medical cannabis farmers' market" as a building, structure or place, used by one or more registered caregivers or registered dispensaries and licensed by the Department of Administrative and Financial Services, Office of Cannabis Policy, for the direct sale of harvested cannabis and cannabis products to qualifying patients and for the consumption of harvested cannabis and cannabis products purchased by qualifying patients from the registered caregivers or registered dispensaries. The office is directed to provisionally adopt major substantive rules regarding the licensure, operation and administration of medical cannabis farmers' markets and to submit those rules for legislative review by January 9, 2026. The bill authorizes, for tax years beginning on or after January 1, 2026, a refundable tax credit for an employer that pays or provides in-kind resources for child care for the children of its employees.
