This bill, the Medicaid Patient Abuse Prevention Act, aims to clarify the authority of state Medicaid fraud and abuse control units to investigate and prosecute cases of Medicaid patient abuse and neglect in any setting, not just in Medicaid-funded health care facilities or certain board-and-care facilities as is currently allowed. Specifically, the bill would allow these units to review complaints regarding Medicaid patients who are in non-institutional or other settings. Additionally, the bill removes the requirement that such funding be found necessary by the Secretary for the elimination of fraud in the provision and administration of medical assistance under the state Medicaid plan.
