This bill amends the Education Code to change the requirements for determining resident status of students at public institutions of higher education in Texas. The key provisions are: 1. Maintains the existing requirements for establishing residency based on the student or their parent having established and maintained a domicile in Texas for at least one year prior to enrollment. 2. Removes the provision that allowed a student to establish residency if they had graduated from a Texas high school and maintained a residence in Texas for three years prior to graduation and the year prior to enrollment. 3. Prohibits a person who is not authorized under federal law to be present in the U.S. from being considered a Texas resident for tuition purposes. 4. Allows public institutions to reclassify as non-residents students previously classified as residents under the now-removed high school graduation provision or if they are not authorized to be present in the U.S. The bill takes effect on September 1, 2019.
