This bill relates to the treatment and placement of incarcerated individuals based on their gender identity. It requires that incarcerated individuals who have a gender identity different from their assigned sex at birth be addressed and provided access to commissary items, clothing, and other materials consistent with their gender identity. The bill also establishes that these individuals shall be presumptively placed in a correctional facility with persons of the gender that most closely aligns with their gender identity, unless they opt out of such placement. The bill further prohibits transgender individuals from being placed in protective custody for more than 30 days due to harassment or violence related to their gender identity.
