This bill relates to the treatment and placement of incarcerated individuals based on their gender identity. It requires that incarcerated individuals who have a gender identity different from their assigned sex at birth be addressed and provided access to commissary items, clothing, and other materials consistent with their gender identity. The bill also establishes that these individuals shall be presumptively placed in correctional facilities with persons of the gender that most closely aligns with their gender identity, unless they opt out of such placement. The bill further provides that transgender individuals experiencing harassment, violence, or threats due to their gender identity cannot be placed in protective custody for more than 30 days and must be housed in the least-restrictive setting where they will be safe.
