This bill enacts the "Manufacturer Disclosure and Transparency Act," which requires prescription drug manufacturers to notify the New York State Attorney General of any arrangements with other pharmaceutical manufacturers that have the purpose or effect of delaying or preventing the introduction of generic drug alternatives. The Attorney General is then required to share this information with the state's Drug Utilization Review Board, Medicaid managed care plans, health carriers, and pharmacy benefits managers. The Attorney General is also required to post all the notices on their website in a searchable format for public review. Manufacturers that fail to properly notify the Attorney General can be fined up to $10,000 per violation. The bill also authorizes the Attorney General to promulgate rules and regulations necessary for its implementation.
