This bill, known as the "Manufacturer Disclosure and Transparency Act," requires prescription drug manufacturers to notify the New York State Attorney General of any arrangements, either through agreements or otherwise, that have the purpose or effect of delaying or preventing the introduction of a generic substitute for a brand-name drug into the marketplace. The manufacturers must provide details such as the drug's name, wholesale price, the disease it treats, the manufacturers involved, and the length of the delay. The Attorney General is then required to share this information with the state's Drug Utilization Review Board, Medicaid managed care plans, health carriers, and pharmacy benefit managers. The bill also mandates the Attorney General to post all the notices on their website in a searchable format for public review. Manufacturers who knowingly or negligently fail to comply with the notification requirements can be fined a minimum of $5,000 for the first violation and $10,000 for each subsequent violation per day.
