This bill amends the Workers' Compensation Law to address the use of contracted network pharmacies. It allows employers or carriers to encourage, but not require, claimants to obtain prescribed medicines from a contracted pharmacy. Claimants can still choose to obtain medicines from any registered in-state pharmacy, and the employer or carrier will be liable for the charges as per the fee schedule. The bill also permits certain licensed New York pharmacists to dispense medication outside the network in specific situations, such as when the carrier has refused to pay or the medication needs monthly reauthorization. These pharmacists must follow the fee schedule, treatment guidelines, and pharmacy formulary. Upon approval, the pharmacy will receive prompt payment and can continue providing the medication even after the case is established outside the network.
