This bill, known as the "Red Tape Repealer Act," aims to create a rule baseline budget for state agencies and impose a two-for-one net decrease in rules between January 1, 2020, and January 1, 2022. The Office of Management and Enterprise Services (or a designated agency) will develop the initial rule baseline budget, and any subsequent rule requirement not included in the initial budget will be considered a new rule. Agencies proposing new rules must submit a "rule replacement request" to the Office, which will evaluate the requests based on factors such as necessity, cost-effectiveness, and impact on the economy. The Office can only approve a rule replacement request if the total number of rules for the requesting agency is kept at or reduced from the baseline budget, with some exceptions for rules necessary to protect public health, safety, and welfare. The Office must also submit annual reports on the status of the rule baseline budget.
