This bill authorizes the city of Lowell to transfer air rights over certain parcels of park and state land to the Lowell School Department for the construction of pedestrian bridges for a new high school. The commissioner of capital asset management and maintenance, in consultation with the commissioner of conservation and recreation, can grant or release the Commonwealth's real property interests to allow the city of Lowell to acquire these air rights. An independent appraisal of the fair market value and value in use of the rights must be conducted, and the city of Lowell must transfer land, an interest in land, or funding for the acquisition of land equal to or greater than the appraised value to the Department of Conservation and Recreation for conservation and recreation purposes. The city of Lowell must also assume all costs associated with executing the grant or release of the air rights.
