AN ACT to amend the executive law, in relation to parole eligibility for certain inmates aged fifty-five or older

This bill amends the Executive Law to establish a new parole eligibility provision for inmates aged 55 or older who have served at least 15 years of their determinate or indeterminate sentence. Under this bill, the Parole Board must hold a hearing to determine whether such an inmate should be released to community supervision, even if they have not served the minimum sentence imposed by the judge. If the Parole Board finds a reasonable probability that the inmate will live and remain at liberty without violating the law and that their release is not incompatible with public welfare, they must release the inmate to community supervision.
