This Concurrent Resolution proposes an amendment to the New Jersey State Constitution to establish a fundamental right for every person to a clean and healthy environment, encompassing pure water, clean air, and ecologically sound habitats, and to protect the natural, scenic, historic, and esthetic qualities of the environment, stating that the State cannot violate these rights through its actions or lack thereof. Furthermore, it designates the State as a trustee responsible for conserving and maintaining public natural resources, such as water, air, flora, fauna, climate, and public lands, for the benefit of all people, including future generations, and clarifies that these rights are self-executing and in addition to existing legal protections. If approved by the legislature, this proposed amendment will be put to a public vote at the next general election, with specific requirements for its publication and presentation on the ballot, and if passed by the voters, it will become part of the Constitution on the following March 1st.
