Bill Summary

AN ACT to amend the insurance law and the public health law, in relation to prohibiting certain requirements in insurance contracts

AI Summary

This bill prohibits insurers and health maintenance organizations (HMOs) from including certain requirements in their insurance contracts with healthcare providers. Specifically, it prohibits contracts that: (1) require the insurer to include all members of a provider group in its network; (2) require the insurer to place all members of a provider group in the same network tier; (3) require the insurer to include all members of a provider group in all of its products; (4) prohibit the insurer from using benefit designs to encourage members to seek services from higher-value providers; (5) contain a most-favored-nation provision; and (6) limit the ability of the insurer or provider to disclose fees or allowed amounts to the insured. Any existing contracts with such provisions will be null and void as of January 1, 2021, though the remaining clauses of the contract will remain in effect.
