Bill Summary
A BILL To protect our democracy by preventing abuses of presidential power, restoring checks and balances and accountability and transparency in government, and defending elections against foreign interference, and for other purposes. 1
AI Summary
This bill, the Protecting Our Democracy Act, proposes to:
Prevent abuses of presidential power by establishing congressional oversight of the pardon power, prohibiting presidential self-pardons, and tolling the statute of limitations for federal crimes committed by the President or Vice President during or prior to their time in office. It also seeks to enforce the Foreign and Domestic Emoluments Clauses of the Constitution.
Restore checks and balances, accountability, and transparency in government by strengthening congressional subpoena power, reasserting congressional control over impoundment of appropriated funds, and protecting the independence of Inspectors General and whistleblowers.
Defend elections against foreign interference by requiring reporting of foreign contacts by federal campaigns, clarifying the prohibition on foreign money in elections, and increasing penalties for violations.
The bill also includes provisions to ensure severability in case any part is found unconstitutional.
