This bill amends the Code of Laws of South Carolina to create the offense of "Unlawful Dissemination of Sexually Explicit Materials." It makes it unlawful for a person, without a clear public purpose, to disseminate or sell any visual depiction of another person in a state of sexually explicit nudity, if the person knows they are not licensed or privileged to do so and the depicted person suffers emotional distress or embarrassment. Violations of this law would be punishable by a fine of up to $1,000 or imprisonment for up to one year.
