This bill creates a new offense in the state of South Carolina called "Unlawful Dissemination of Sexually Explicit Materials." The bill prohibits the dissemination or sale of any visual depiction of a person in a state of sexually explicit nudity, as defined in the existing law, if the person disseminating the material knows or has reason to know they are not licensed or privileged to do so, and the depicted person suffers emotional distress or embarrassment as a result. A violation of this new law would be a misdemeanor punishable by a fine of up to $1,000 or imprisonment of up to one year.
