AN ACT to amend the environmental conservation law, in relation to prohibiting coal tar in pavement products

This bill prohibits the sale and use of pavement products containing coal tar in New York. Coal tar is defined as a viscous substance obtained from the distillation of coal that contains high levels of polycyclic aromatic hydrocarbons (PAHs). The bill prohibits the sale of pavement products containing coal tar and the application of such products on driveways or parking areas. The bill does not preempt any local laws restricting the use of coal tar pavement products that were adopted prior to the effective date of this act. The sale prohibition takes effect 12 months after the bill becomes law, and the application prohibition takes effect 24 months after the bill becomes law.
