This bill amends the public health law and the insurance law to require health insurers to offer coverage for health care provided by out-of-network providers. Specifically, it requires health maintenance organizations (HMOs) to offer out-of-network coverage as an optional rider to any contract and to offer at least one contract option that includes out-of-network coverage. The bill also requires all health insurers subject to the insurance law to offer out-of-network coverage as an optional rider to any policy and to offer at least one policy option that includes out-of-network coverage. These options must be made available both within and outside the statewide health benefit exchange.
