This bill amends the Public Officers Law to require entities that submit records to state agencies that are excepted from disclosure under the Freedom of Information Law (FOIL) to periodically re-apply for the exception. Specifically, the bill requires the submitter to request the exception in writing, identify the specific portions of the record subject to the request, and state the reasons why the information should be excepted from disclosure for a defined period of time, not exceeding three years. The submitter may also apply for a three-year extension of the exception request, and the agency must review and either grant or deny the extension request. If the submitter fails to apply for an extension, the exception will expire.
