Bill Summary

AN ACT to amend the penal law, in relation to justification for the use of deadly physical force by a police or peace officer

AI Summary

This bill amends the New York Penal Law to limit the circumstances in which a police officer or peace officer can use deadly physical force. The bill specifies that deadly force can only be used when the officer reasonably believes the person committed a felony that threatened or resulted in death or serious bodily injury, and the person will cause death or serious injury to another person unless immediately apprehended. The bill also requires officers to, where feasible, identify themselves as an officer and warn that deadly force may be used, unless the person is already aware of that. Additionally, the bill prohibits officers from using deadly force against a person based solely on the danger they pose to themselves, if a reasonable officer would not believe the person poses an immediate threat of death or serious injury to the officer or another person.
