This bill amends the civil service law to allow public employees, including those in the New York state and local employees' retirement system and the New York state teachers' retirement system, to use their accrued sick time, compensation time, personal time, or vacation time during any waiting period for workers' compensation benefits or during a period when their claim is being contested. The bill also specifies that employers cannot require employees to use their accrued time during these periods and that employees are entitled to have their time restored if they are subsequently found to be entitled to workers' compensation benefits. The provisions of the bill do not apply to employees covered by a collective bargaining agreement, but employee organizations can opt in or opt out of the bill's provisions through collective bargaining.
