This bill amends the civil service law to allow public employees in New York, such as state, county, and municipal workers, to use their accrued sick time, compensation time, or vacation time during any waiting period for workers' compensation benefits or periods when their claim is being contested. The bill prohibits employers from requiring employees to use their accrued time during these periods. If the employee is later found to be entitled to workers' compensation benefits, their used accrued time will be fully restored. The provisions of this bill do not apply to employees covered by a collective bargaining agreement, but employee organizations can choose to opt in or out of the bill's provisions through collective bargaining.
