Finally, it adds a provision that an aggrieved employee or prospective employee must prove by clear and convincing evidence that a violation of the drug testing law directly caused their claimed damages to be eligible for relief, such as reinstatement or back pay, and also allows for reasonable attorney fees and court costs in such cases.
