This bill amends the Education Code to change the requirements for determining resident status of students at public institutions of higher education in Texas. The key provisions include: (1) removing the option for students who graduated from a Texas high school to be considered Texas residents, (2) clarifying that a person not authorized to be present in the U.S. under federal law cannot be considered a Texas resident, and (3) allowing public universities to reclassify certain previously-classified resident students as non-residents, either if they no longer meet the residency requirements or if they are not authorized to be present in the U.S. The bill takes effect on September 1, 2021.
