This bill establishes the offenses of reckless endangerment of an "emergency service person" in the first and second degrees. An "emergency service person" is defined as a firefighter, police officer, peace officer, emergency services professional, code enforcement officer, fire inspection personnel, or building inspector. The second-degree offense applies to individuals who, without a required building permit, alter, convert, enclose, subdivide, or partition a building in a way that impedes a person's egress during a fire or other emergency, resulting in injury to an emergency service person. The first-degree offense applies when such conduct results in the death of an emergency service person or the individual has a prior conviction for the first or second-degree offense within the last ten years. The bill makes the second-degree offense a Class E felony and the first-degree offense a Class D felony.
