This bill, the Equity and Inclusion Enforcement Act of 2021, amends Title VI of the Civil Rights Act of 1964 to restore the right to individual civil actions in cases involving disparate impact, which refers to policies or practices that have a disproportionate negative effect on a protected group, even if the impact was unintentional. The bill also requires recipients of federal education funding to designate at least one employee to coordinate compliance with Title VI and notify students and employees of that individual's contact information. Additionally, the bill creates a new position within the Department of Education, the Special Assistant for Equity and Inclusion, to promote, coordinate, and evaluate efforts to ensure compliance with Title VI and inform individuals of their rights under the law.
