Bill Summary

AN ACT to amend the education law, in relation to school climate and codes of conduct on school property and disciplinary action following violation of such codes of conduct; and to amend the education law, in relation to making conforming amendments

AI Summary

This bill amends the education law to: - Require school districts, boards of cooperative educational services, and charter schools to adopt codes of conduct that promote and sustain safe, respectful, and supportive school environments, and define violations and set clear expectations for student conduct. The codes must use the least severe action necessary to respond to violations, prioritize restorative practices and interventions, and prohibit certain disciplinary actions like suspensions for tardiness, absence, dress code violations, and initial or repeated acts of willful disobedience. - Require districts to provide professional development on the code of conduct, interventions, and graduated and proportionate discipline. - Establish procedures for suspending students, including requiring written notice, a hearing, the opportunity for the student and parent to present evidence and be represented by an attorney or advocate, and the issuance of a written decision. - Limit the circumstances under which students can be suspended or removed from the classroom, and require schools to create an education plan and allow students to make up work during any removal or suspension. - Make conforming amendments to related provisions regarding discipline of students with disabilities and the transfer of disciplinary records.
