This bill prohibits certain telephonic sales calls without the prior express written consent of the called party. It removes provisions authorizing the use of certain automated telephone dialing systems and allows a court to increase an award for willful and knowing violations. The bill defines "prior express written consent" and establishes a rebuttable presumption that a telephonic sales call made to an area code in Florida is made to a Florida resident or person in the state. It also allows a called party who is aggrieved by a violation to seek injunctive relief and recover actual damages or $500, whichever is greater, and allows the court to increase the award if the violation was willful or knowing.
