This bill aims to protect Colorado residents from unfair discrimination in insurance practices. It prohibits insurers from using external consumer data, algorithms, and predictive models that result in unfair discrimination based on race, color, national or ethnic origin, religion, sex, sexual orientation, disability, gender identity, or gender expression. The bill requires the Commissioner of Insurance to adopt rules that establish means for insurers to demonstrate that their use of such data and tools does not result in unfair discrimination. The Commissioner must also engage in a stakeholder process prior to adopting the rules, which will not take effect until January 1, 2023, at the earliest, to allow consideration of any solvency impacts on insurers.
