This Concurrent Resolution formally requests the State Auditor to conduct a comprehensive social and financial assessment of House Bill No. 249, a proposed law that would require health insurers, mutual benefit societies, and health maintenance organizations to cover a wide range of reproductive health services, drugs, devices, products, and procedures without any out-of-pocket costs for individuals. The resolution is prompted by concerns over the potential erosion of federal protections for reproductive healthcare and the need for state-level safeguards, as well as the potential financial impact on residents if the Patient Protection and Affordable Care Act (ACA) were repealed. Specifically, the Auditor is asked to determine if the mandated benefits exceed the ACA's "essential health benefits" (minimum required coverage standards for health plans) and if mandating full coverage at no cost-sharing violates Section 1303 of the ACA, which addresses the use of federal funds for abortion services. The Auditor is to submit a report of their findings and recommendations to the Legislature before the start of the 2023 legislative session.
