This bill, the Junk Plan Accountability and Disclosure Act of 2021, aims to: 1) Prohibit false or misleading online advertising for health insurance coverage, including deceptive ads that suggest they are from government entities or misrepresent the costs and benefits of non-Affordable Care Act (ACA) compliant health plans compared to qualified health plans. The Federal Trade Commission will enforce these prohibitions. 2) Require non-ACA compliant health plans to provide clear disclosures to consumers about the limited benefits they cover, encourage enrollment in more comprehensive qualified health plans, and report data on their enrollment and marketing practices. The Department of Health and Human Services will enforce these requirements. 3) Mandate outreach and educational activities by the federal health insurance marketplace to inform consumers about qualified health plans and financial assistance, set annual enrollment targets, and provide grants to states for similar outreach efforts. The bill also requires transparency in the federal government's health insurance marketplace operations and spending.
