This bill amends Chapter 111 of the General Laws to prohibit integrated health care systems from negotiating contracts jointly with public and private payers. Instead, each facility within the system must negotiate separate contracts and establish separate negotiating teams. The bill also requires the facilities to implement firewalls to prevent the sharing of information that could inhibit competition. The Department of Public Health and the Office of the Attorney General are given the authority to enforce these requirements. The Department may grant exemptions if the system can demonstrate it is sufficiently integrated, based on factors such as the use of alternative payment arrangements, a unified electronic medical record system, quality improvement initiatives, and measures to eliminate unnecessary duplication of services.
