This bill amends Massachusetts law to require that prospective purchasers of residential properties be notified about the potential presence of 1,4 Dioxane, a hazardous chemical, in the property's well water. The bill directs the state Commissioner of Public Health to prepare a standard notification form and materials to inform prospective buyers about the issue. Sellers and real estate agents are required to provide this information to prospective buyers prior to the signing of a purchase and sale agreement, and must also disclose any known information about the presence of 1,4 Dioxane. The bill also gives prospective buyers the right to test the water and allows for a 10-day contingency period in the purchase agreement. It imposes penalties on owners who fail to comply with the disclosure requirements.
