This bill aims to further define abuse and neglect of children. It amends Section 21 of Chapter 119 of the General Laws to provide definitions for "abuse" (both physical and sexual), "neglect" (the failure of a caregiver to provide essential care), "physical abuse" (a non-accidental act that causes or risks physical injury), and "sexual abuse" (a non-accidental sexual act with a child that causes harm or substantial risk of harm, sexual contact between a caregiver and child, or sexual contact between a child and any individual, subject to certain exceptions). The bill clarifies that abuse can be committed by any individual, not just a caregiver, and that neglect can be deliberate or due to negligence or inability, but not solely due to inadequate economic resources or a handicapping condition.
