This bill requires all public employers in Massachusetts to register and participate in the federal work authorization program (also known as E-Verify) to verify the employment eligibility of all new hires. It also mandates that public employers, contractors, and subcontractors of a certain size (500 or more employees starting July 1, 2022, and 100 or more employees starting July 1, 2022, expanding to all employers by July 1, 2023) must register and use E-Verify to verify the employment eligibility of new hires. The bill imposes fines of at least $5,000 on contractors or subcontractors who hire undocumented workers without verifying their information through E-Verify. The commissioner of the Massachusetts Department of Labor and Workforce Development is responsible for promulgating rules and regulations to administer the program, while the commissioner of the Massachusetts Department of Transportation is responsible for rules and regulations related to public transportation contracts.
