This bill amends the existing law to require tenants or occupants who are invoking the "rent escrow" provision in a summary process (eviction) action to deposit with the court the amount due for use and occupancy each month or the amount required under the rental agreement. These amounts, which must include any amount due from the start of withholding and are to be calculated based on the fair market value of the premises, will be held in escrow pending the final disposition of the eviction case. The bill also provides that if the tenant or occupant fails to comply with the court's order to make the required deposits, the court shall schedule the case for a bench trial at the earliest available date and make any other orders it deems appropriate.
