This bill amends the Massachusetts law on child custody orders. It prohibits courts from issuing temporary or permanent sole, shared legal, or shared physical custody orders to a parent against whom an active restraining order has been issued under domestic violence or harassment laws, unless the parent who filed the restraining order consents to the custody award. The bill also prohibits courts from issuing permanent custody orders during the pendency of a restraining order complaint or while a temporary restraining order is in place, until the defendant has had an opportunity to be heard. If a restraining order is later issued, the court must revisit and modify any existing custody order to conform with these requirements.
