This bill enacts a new section of the Ohio Revised Code to establish conditions and requirements for the sale of brine from oil or gas operations as a "commodity." A "commodity" is defined as brine that has been processed or recycled to remove contaminants. The bill requires the holder of a permit, order, or approval to demonstrate to the chief of the Division of Oil and Gas Resources Management that the intended use of the commodity is not expected to result in damage or injury to public health, safety, or the environment. The commodity must meet certain chemical and radiological standards and be approved for specific uses such as deicing or dust control. The bill exempts the commodity from requirements otherwise applicable to brine, allowing the permit holder to sell it for approved uses. The chief may establish reporting requirements and collect samples to confirm compliance.
