This bill permits the court to order counseling for children in households with domestic violence in appropriate cases, and establishes a presumption of awarding custody to the domestic violence victim in appropriate cases. Specifically, the bill amends existing law to allow the court to order the defendant to pay for a child to receive professional domestic violence counseling, and to reimburse the victim for costs associated with providing such counseling. The bill also establishes a presumption that legal and physical custody shall be awarded to the non-abusive parent upon entry of a final restraining order, while allowing the non-custodial parent to apply to modify the custody arrangement.
