This bill establishes the crime of "aggravated harassment by means of electronic or digital communication." It prohibits the production, distribution, publication, or broadcasting of material that contains a digitized image (known as a "deep fake") in which the image of a person is superimposed without their explicit written permission, and where the image depicts a pornographic or lewd sex act or graphic violence. The bill also provides a private right of action for the unlawful dissemination or publication of deep fakes and other intimate images, allowing individuals to seek injunctive relief, punitive damages, and other remedies.
